For now, the government does not intend to introduce compulsory administration in the Municipality of Budva because there is no legal basis for such action, regardless of the fact that the President of the Municipality, Rajko Kuljača, and his Vice-President, Dragan Marović, are in pre-trial detention.
In the response of the Government Bureau for Public Relations to the questions of "Vijesti" addressed to Prime Minister Igor Lukšić, it is written that the Constitution stipulates that the municipality is independent in performing its responsibilities.
"The government can dissolve the municipal assembly, that is, dismiss the president of the municipality, only if they do not perform their duties for more than six months," the answer reads.
It is added that the Law on Local Self-Government stipulates that it is considered that the president of the municipality does not perform tasks within his competence, if he does not ensure the execution of laws, other regulations and general acts, the implementation of strategic documents of state importance... It is also noted that the vice president of the municipality replaces the President in his absence. Budva is currently led by vice president Lazar Rađenović.
It also says that the European Charter on Local Self-Government stipulates that "local authorities can determine their own internal organization of administration, in order to adapt it to local needs and ensure efficient administration".
When asked whether and what solution the Government will offer for the problem facing the Municipality of Budva, the essence of the answer is that the municipality is independent in performing its duties and that the Government has a limited supervisory function and a very small repressive function in relation to local self-government bodies.
