The method of making the illegal decision of the Senate of the University and the method of its execution, unequivocally confirmed that the main motive for its adoption was its one-time use, with the aim of trying to discredit Aleksa Bečić and the strongest opposition party he leads, announced the member of the presidency of Democratic Montenegro, Neven Gošović.
"Even a first-year law student would have understood that the Senate of the University of Montenegro conducted an illegal and unconstitutional proceeding against the leader of the Democrats, purely politically motivated, and that the procrastination of the courts in making a decision enabled the conduct of dirty and cheap media propaganda by the regime and its supporters." announced Gošović.
The decision of the Constitutional Court, as stated by Gošović, confirmed what Bečić communicated during the proceedings claiming that an unconstitutional politically staged process was conducted against him.
"By overturning the 'umbrella' Decision on the basis of which all further legal steps were taken in the case against Bečić, it is clear that, legally speaking, all other legal actions 'fall', i.e. that all decisions of the University and the Faculty of Economics that were made on the basis of is an unconstitutional decision of the University, also absolutely illegal," adds Gošović.
For that, Gošović points out, there is no need to explain that in the legal system of Montenegro, individual acts passed on the basis of a general act - the decision of the Senate of the University, which the Constitutional Court judged to be inconsistent with the Constitution and the law, cannot survive.
"However, we have to ask ourselves where is the responsibility of the Senate, where is the responsibility of the rector of the University, where is the responsibility of the Council of the Faculty of Economics and the dean of that faculty. Where is their responsibility, because they have been repeatedly warned by the public and the profession that they are conducting an illegal and unconstitutional politically motivated process against the leader of the strongest opposition political party. Who will compensate for the media satanization and persecution that Aleksa Bečić and the Party he leads were exposed to for almost two years?" asked Gošović.
"The manner in which the illegal decision of the Senate of the University was made and the manner in which it was executed unequivocally confirmed that the main motive behind its adoption was its one-time use, with the aim of trying to discredit Aleksa Bečić and the strongest opposition party he leads. And finally, we have to ask ourselves how far We have arrived as a society in which members of the academic staff, in the most reckless way, violate the law and the Constitution, the Code of Ethics of the University and the moral and professional principles established by it, implementing a politically motivated process at the behest of the head of the regime," concludes Neven Gošović's reaction after the decision of the Constitutional Court.
