The leader of the Budva Democrats, Mijomir Pejović, filed a criminal complaint with the Supreme State Prosecutor Ivica Stanković against Anđela Ivanović, a councilor from Crnogorska in the Budva Municipality Assembly, for false representation.
It's Ivanovic chaired the session today where the new majority in the local parliament dismissed the president of the Municipality of Budva, Marko Carević, and the president of the SO of Budva, Krsto Radović.
We transmit the criminal complaint in its entirety:
"Anđela Ivanović knowingly and willingly, on June 11.06.2020, 13, unauthorizedly representing herself as the chairperson of the Budva Municipality Assembly contrary to the provisions of the Law on Local Self-Government, the Statute of the Municipality of Budva and the Rules of Procedure of the Budva Municipality Assembly, scheduled and presided over the alleged session of the Budva Municipality Assembly in the conference hall of TN "Slovenska plaža" at XNUMX:XNUMX p.m., due to the illegal removal of legally elected authorities and the seizure of power by political corruption.
- by which she committed the criminal offense of false representation from Article 383. paragraph 1 in connection with the criminal offense of self-government from Article 384. paragraph 1 of the Criminal Code of Montenegro.
Explanation
On April 30.04.2020, 04.05.2020. In XNUMX, a group of councilors of the Budva Municipal Assembly submitted to the Budva Municipal Assembly a proposal for the dismissal of the municipal president, Marko Carevic, and a request for convening a session. On XNUMX. The same group of councilors also submitted a proposal for the dismissal of the president of Budva Municipal Council, Krsto Radović.
In accordance with the provisions of Article 40 paragraph 6 of the Law on Local Self-Government and Article 76 paragraph 1 of the Statute of the Municipality of Budva, the President of the Municipality of Budva, Krsto Radović, convened the assembly session, based on the proposals for the dismissal of the mayor and the president of the Assembly, within 15 days from the date of submission of the proposal, and determined the date of their holding within 15 days from the day of convening.
The Assembly session based on the submitted proposal for the dismissal of the municipal president was held on May 29.05 and May 30.05.2020, 29.05. year, while the session based on the submitted Proposal for the dismissal of the President of the Assembly was held on May 03.06.2020 and June XNUMX, XNUMX. years.
At the aforementioned sessions, the existence of a quorum was determined, the proposed agenda was adopted, the debate was opened, the representative of the proponent was allowed to explain the proposal, the mayor and the president of the assembly were allowed to state the reasons for their dismissal, reports of the working bodies of the assembly were obtained, after which and the discussion by the councilors began.
The proposers left the Assembly sessions on May 30.05.2020, 03.06.2020. year and day 62. year, which is the condition that due to the lack of a quorum of the Assembly session, according to the submitted Proposals for the dismissal of the municipal president and the President of the Assembly, they will be terminated and their continuation, in accordance with Article 40 of the Rules of Procedure of the Assembly of the Municipality of Budva and Article 6 paragraph 29.06.2020 of the Law on Local Self-Government, is set for June XNUMX, XNUMX . years.
Despite the fact that the legally elected president of the municipal assembly and the chairman of the session, in accordance with the law, scheduled the continuation of the session at which the submitted proposals of the group of councilors are to be discussed, the group of councilors on 08.03.2020. submitted the convening of the session of the Budva municipality assembly, in everything contrary to the law on local self-government, the statute of the municipality of Budva and the rules of procedure of the Budva municipal council, by which it illegally convenes the Budva municipal council session for June 11.06.2020, 10. year at XNUMX a.m. in the premises of SO Budva.
President of the Budva Municipal Council on 11.06.2020. at 10:11 a.m. verbally informed a group of councilors led by the reported Anđela Ivanović that in accordance with the law on local self-government, the law on state property, the municipal statute and the rules of procedure of SO Budva, the assembly hall cannot be used for illegal purposes. After this notification, the registered Anđela Ivanović sent from her e-mail address at 56:13 a.m. to all the councilors of the SO Budvavanavodni meeting for the session of the SO Budva in the conference hall "TN Slovenska plaža" at XNUMX p.m.
At 13:XNUMX p.m., a group of councilors gathered in the conference hall "TN Slovenska plaža" led by the reported Anđelo Ivanović, who assumed the chairmanship of the described meeting, falsely presenting herself as the chairwoman of the Budva municipality assembly. At the aforementioned meeting, alleged decisions were made on the dismissal of the president of the assembly, the president of the municipality and the appointment of the acting president of the municipality, all of which were signed without authorization by the reported Anđela Ivanović.
With her actions, the reported Anđela Ivanović knowingly and recklessly committed the criminal offense of self-government in conjunction with the criminal offense of false representation, in order to illegally and unconstitutionally try to seize power for the interests of the group of councilors of DPS, Crnogorska, SD and councilor Stevan Džaković.
Bearing in mind the above, we demand that the Supreme State Prosecutor's Office submit this criminal complaint for processing to the competent state prosecutor's office, which will immediately implement the necessary actions and, based on the overall established factual situation, take measures of criminal legal responsibility against the criminally reported persons," the criminal complaint states.
