The decision of the authorities of the Democratic Party of Socialists (DPS) to appropriate property to religious communities through a special law, suspending the Constitution of Montenegro, basic legal principles and civilizational values, cannot be implemented in practice and be sustainable, Nikola Rovčanin, spokesman for Democratic Montenegro, announced today.
"This is confirmed by the most recent examples from the practice of the European Court of Human Rights in Strasbourg. They further expose the political motivation and party calculations of Đukanović and Marković, calculated during the adoption of the anti-European and anti-civilization law on kidnapping, to the core," Rovčanin pointed out.
He added that the judgment of the European Court of Human Rights handed down three days ago in the case of Nešić v. Montenegro unequivocally shows that the contested provisions of the Law on Freedom of Religion are contrary to European standards.
"Strasbourg in that case explicitly states that the existence of a legal basis in domestic law, in itself, is insufficient to satisfy the principle of legality when it comes to encroachment on the right to property. In other words, it is a clear message to the DPS that it is not enough for those with satellites to adopt a law in the dead of night, it is necessary for that law to be in accordance with European standards," Rovčanin said.
He said that the judgment further states that any confiscation of property must be compensated with fair compensation, as prescribed by the European Convention for the Protection of Human Rights.
"However, we are witnesses that the Law on Freedom of Religion does not provide for fair compensation, nor could it provide for, because religious buildings have an inestimable value. They are cultural and historical treasures and as such should not be subject to confiscation or sale," said the spokesperson. Democrat.
Rovčanin stated that it is obvious that the Government, in addition to stealing state property, is also continuously stealing other people's property.
"Victims of such greed were previously, among others, the owners of land in the zone of maritime property, and now it is the turn of religious communities. It is also clear that the Montenegrin judicial institutions are powerless to deal with the extortionist politics of the DPS and, unfortunately, citizens they have to wait for justice to arrive from Strasbourg," Rovčanin said. According to him, it is already clear from this verdict that the planned confiscation of property of religious communities is contrary to European legal standards.
"It is absurd that in the end the citizens pay for the violation of human rights, so these days, according to an earlier judgment of Strasbourg, a multimillion-dollar amount will be paid from the budget. Therefore, the citizens, in addition to financing hydropower plants for members of the DPS president's family, pay the guild for these violations human rights in which the DPS obviously does not stop," concluded Rovčanin.
