There is no end to questionable jobs, elections and contracts in the Bar water supply system, announced today Momčilo Leković, member of Democratic Montenegro in the Bar Municipal Assembly.
"Based on the received documentation and Contract No. 5220 dated 31.07.2019/XNUMX/XNUMX between Mladen Đuričić, the company's executive director, and Neđeljko Čović, the chairman of the board of directors, and by looking at the provisions of the statute of this company, it can be clearly concluded that it has been grossly violated" , Leković pointed out.
He added that in Article 3 of the contract in question, it is defined that the Executive Director establishes an employment relationship for an "indefinite period of time", which, as Leković adds, is in obvious conflict with Article 27 of the Statute of DOO "Vodovod i kanalizacija", in which paragraph 2 states that "The executive director establishes an employment relationship for a certain period of time".
"And this is not all, the contract and Article 13 further specify that the director, after the termination of his position, has the right to be assigned to another position of his own choice, which is not lower than the position of advisor to the director, or to exercise the right to severance pay. Therefore, this is definitely violated a clear statutory provision according to which the employment relationship of the Executive Director is limited in time, as stated in the statute for a certain period of time," said Leković.
He said that regardless of the fact that the Labor Law foresees the possibility that director contracts can be concluded both for a fixed and indefinite period, the statute of the bar company is clear and it says that the employment relationship of the executive director can be based exclusively on a fixed period of time without any what possibilities for elections and extension of the employment relationship.
"It is obvious that such contracts have become a practice in DOO "Vodovod i Kanalizacija", which leads to an unusual situation, that the company has several advisers to the director, while the contracts of individual advisers who are also councilors of the Democratic Party of Socialists (DPS) they still consider it a "state secret". All of this must result in an urgent reaction of the competent authorities in order to investigate these but also all other actions and contracts and to check this DPS party branch to the last detail," concluded Leković.
