Bogdanović: Katnić to immediately publish all the transcripts of the conversations that he eavesdropped on without a legal basis

Boris Bogdanović, MP of Democratic Montenegro, called on the chief special prosecutor, Milivoj Katnić, to immediately publish all the transcripts of the conversations that, as it is stated, he had apparently eavesdropped on for years without any legal basis.

Bogdanović claims that neither he nor his colleagues have anything to hide from citizens.

"Prosecutor Katnić is obliged to explain to the public, as well as to the competent authorities, on what basis, according to which law, on the basis of which article and position, the wiretapping of me and my colleagues was carried out? Where is the basis and basis for such an action, or is the legitimacy such treatment received in the decisions and orders of the DPS, which he obviously follows without question? I do not know if Mr. Katnić is familiar with and if he has ever read article 160 point 7 of the Law on Criminal Procedure and if so, why he did not act according to the letter of this law For the sake of the public, I will quote the aforementioned article: "If the state prosecutor decides not to initiate criminal proceedings, i.e. if the data and information collected through the application of secret surveillance measures are not required for criminal proceedings, he will submit the material obtained by applying Article 157 of this Code in a sealed envelope with a special MTN mark to the judge for the investigation, who will order the material to be destroyed in the presence of the state prosecutor and the judge for the investigation, about which the judge for the investigation will make a record. So, that's enough for smart people," said Bogdanović's press release.

He adds that the Criminal Code clearly stipulates that secret surveillance measures can last no longer than 18 months.

"I remind you that the secret surveillance measures were determined in 2017. From then until now, 4 years have passed. The materials that had to be destroyed were delivered to the public through abuse of official position, allegedly for the purpose of objectively informing the public. he violated the provisions of the Law on Criminal Procedure. Which is obviously not the first time, because the party order is "executive" this time as well. Article 162 paragraph 1 of the ZOP stipulates that "Before destroying the material obtained through secret surveillance measures, the investigating judge will inform the person against whom the measure was taken, and that person has the right to inspect the collected material". Who is the judge for the investigation, Mr. Katnić, and why did he not comply with this order, if he did everything in accordance with the Law?" writes Bogdanović.

The Democrat MP further states that it is completely clear that the entire attack on the Democrat MPs was initiated because of the elections in Nikšić and the attempt to "rescue a political drowning".

"If you thought that you would reach your goal by intimidation, let it be clear to you right away, you were mistaken. At our address, you will never find people who will succumb to threats and fear. When you are already continuously eavesdropping on us, you must have known that we have subordinated our lives to the struggle for the freedom of our country and citizens and that we do not know blackmail, fear, trade and sales. Not at the door of this caucus, you will not find such. But, your failed attempt to discredit the Democrat MPs has left many questions that you must answer, first of all, to the public. When, Who from the Democratic MPs and where did he meet with the special prosecutor Savović? In connection with what? What information did the prosecutor Savović give for 200 euros and what was the alleged consideration? If you claim that someone was indirectly given 200 euros for some kind of information, it is elementary in in order to objectively inform the public and tell the truth what that information is? If you claim that it is about the markets, then as a lawyer you must know that in the sales contract there is a commodity and a price. You have announced the price, we ask you, which goods are they? Next, I ask Mr. Katnić, in which privileged position did Mr. Savović bring Democratic Montenegro or any Democratic official? Answer Mr. Katnić," it says.

Bogdanović points out that key words were omitted from the transcript.

"That's right, I denied yesterday that I financially helped the son of prosecutor Savović and that I didn't know that Mišo was the son of SDT, because Mr. Katnić, I'm only saying what I'm sure of and what I remember. As you know, four years have passed since then and as a politician, I communicate with hundreds of citizens every day (you probably know because you're listening). I've met Miša Savović a dozen times in my life. I can only say that he is an honorable, approachable and educated man, and I'm honored that you reminded me that I tried to help a man, a talent who represented our country in an international, world competition. Thank you for the free promotion of humanity. Also, the transcript of the conversation you provided to the public today is obviously torn in such a way that key words are probably left out, but not in this context either there is nothing in dispute. And the citizens of Montenegro could very easily conclude that. Finally, I remind you that Mr. Katnić, as the chief special prosecutor, chose his team at the beginning of his mandate. It's not like he chose people who can be bought for 200 euros," the announcement reads, among other things.

Bogdanović says that there is no threat, intimidation, blackmail and intimidation that can stop reforms in the prosecutor's office.

"They have already started, that's why you are resorting to this hideous way of political struggle with dissenters. So, Mr. Katnić, your eavesdropping is useless if you have nothing to hear, which is illegal. If you had placed headphones on the right door or, as the people say, bear on the hole, you could became famous and successful. But you didn't want to, nor were you allowed to, so today you are shooting with an empty gun at impeccably clean people and humiliating the institution where you work," concludes Bogdanović.
