The Democratic Party of Socialists (DPS) and the Bosniak Party (BS) announced today that the Venice Commission gave a negative opinion on the proposed changes to the prosecution laws.
The DPS said that it was a "new international embarrassment" for the current government, while the BS said that without a social consensus, there can be no adoption of prosecutorial laws.
The Ministry of Justice, Human and Minority Rights did not announce anything on the occasion, and Minister Vladimir Leposavic participated in the session of the Council of Ministers.
The Venice Commission replied to "Vijesta" that they will publish their opinion on Monday.
"The negative opinion of the Venice Commission on the amendments to the prosecution laws and the position of this international body that there is abuse of legal powers and the undermining of legal security are a sharp warning to this government, that with their revanchist moves, they are increasingly distancing Montenegro from the European agenda. The ruling majority's intention to introduce politics into the judicial system, and accuses and judges from the position of the government, goes against all European and civilizational standards. Also, this epilogue of the attempt to forcefully change the prosecution laws and adapt this institution to the revanchist needs of the Democratic Front and other participants in the government, directly exposed that the Government and the new parliamentary majority are fundamentally ignorant of the legal regulations of the European Union," the DPS stated.
They said that the fact that "such legally bizarre" changes to the law were proposed at all is a great embarrassment to the new government.
"That's why, in the coming period, we expect a series of attempts to escape from responsibility for this kind of fraud. Dritan Abazović was the first to try to do it when, a few days ago, he explained to the European parliamentarians that he and the Government had nothing to do with the disputed proposals for changes to the law. but that the MPs are the proposers?! Abazović just forgot to say that among those MPs there were also those who belong to his party and that he personally supported this attempt at revanchism wrapped in illegal changes to the law," they added in the statement.
They remind that the DPS has repeatedly emphasized in the past months that the abolition of the Special State Prosecutor's Office would lead to "total anarchy in the legal system, which was clearly stated today by the experts of the Venice Commission."
"DPS expects that these amendments to the prosecution laws will be urgently withdrawn from the parliamentary procedure and that the legal system of Montenegro will not be misused according to the revanchist desires and needs of various subjects in the current government. Any other outcome would seriously threaten the rule of law and the European path of Montenegro." they concluded from DPS.
The Bosniak Party announced that the decision of the Venice Commission to "adopt a negative opinion" on the proposed changes to the prosecution laws, which were sent to them by the Minister of Justice, Human and Minority Rights Vladimir Leposavić, is a confirmation of the previous position of the BS that without broad social consensus and agreement with European partners , there is no adoption of prosecutorial laws.
"We welcome this decision of the Venice Commission, which is the only one expected for us in the Bosniak Party, given that the procedure on the laws on prosecution was planned contrary to democratic principles, with the absence of social dialogue. We especially emphasize the position of the Venice Commission that political decisions should be made transparently way and through a public debate, with the involvement of key actors and experts, which is a recommendation that the Bosniak Party pointed to from the very beginning. We believe that after the clear message previously sent from Brussels, that the adoption of such laws would be a backward step in Montenegro's reforms Above, the message from the Venice Commission is sufficient for the parliamentary majority to understand the importance of dialogue, the necessity of a broad public debate and the achievement of the greatest possible consensus of all social actors on such important issues," concludes the BS announcement.
LP: The exposed goal of the Government to sabotage the path to EU and NATO membership
The Liberal Party announced that "the opinion of the Supreme Court exposed the Government's goal to sabotage the path to EU and NATO membership".
"The opinion of the Venice Commission confirmed that the proposals for the law on the prosecution are retrograde and harmful to the state and to the further democratization of society. For a long time we have been warning about the perniciousness of the policy of this Government, which without any reason or basis is roaming around the country and collapsing all the achievements of Montenegro since the restoration of independence Thus, with a set of socio-economic laws, which they quickly forgot, they tried to cover up the scandal of the attempt to put the prosecutor's office under the party control of the DF and the URA. The question arises on whose orders, for whose interest or from what fear are the leaders of this Government, the DF and URA were ready to call into question Montenegro's path to the EU in such a hurry and collapse all democratic and European principles", LP states.
Such a picture, they add, is completed by "another national shame that was prepared for us by the director of the National Security Agency" Dejan Vukšić.
"By revealing strictly guarded information of the secret services of partner NATO member states, they endangered security missions, people's lives and the reputation of Montenegro as a NATO member. It is clear that in addition to permanently undermining Montenegro's European path, they are collapsing legislation, violating human rights and trying to extinguish all institutions with a Montenegrin sign, the leaders of this government want to compromise Montenegro's position in NATO. The question arises when will we finally see the reaction of the prosecutor's office, which is silent on the continuous violation of the law and even the undermining of their role in the system? For this kind of chaos, lawlessness and damage for the state, someone will have to bear responsibility," LP concludes.
