The Director of the National Security Agency (ANB) Dejan Vukšić is directly responsible for the disclosure of classified information, and the prime minister Zdravko Krivokapić is objectively responsible, according to the Movement for Change (PzP).
The president of PzP, Nebojša Medojević, said that "the director is solely responsible for the debunking of secret data of a foreign state by ANB".
"It is very clearly defined in the Law on ANB, which states in Article 26 that the director of the Agency has the authority to take care of the protection of data, means, methods and sources of data from unauthorized access. Bearing in mind that the director of ANB is accountable to the Government for his work and that of the Agency, the objective responsibility lies with the Government and Prime Minister Krivokapić," stated Medojević.
He said that, according to Article 25 of that Law, the director of ANB is responsible to the Government for his work and that of the Agency, and that he cannot be a member of a political party, nor act politically.
"The work of the Agency is without essential control because the Government has not yet appointed the Inspector General of the ANB, and the Prime Minister publicly demands the arrest of members of the Committee for Defense and Security, which is authorized by the Constitution to carry out civilian democratic control of the army and security services," said Medojević.
According to him, the dangerous tendency of the Government of Krivokapić towards non-transparent work, discretionary decisions and ignoring control mechanisms continues.
"The Ministry of Finance very widely uses the possibility of classifying documents with some degree of secrecy. Even for documents which, by their nature and content, must be public and accessible, such as the contracts of the state with investment banks that were the arrangers of the issuance of state bonds and the like", stated Medojević.
He believes that the director of the Agency has direct responsibility for leaking secret information of foreign countries, especially since he was warned in advance.
"Therefore, one can talk about absolute ignorance of the way ANB operates and the management of secret data, or about the intention to cause damage to both ANB and the state of Montenegro," Medojević said.
He said that Vukšić is legally responsible for keeping secret data and the work of the Agency and that he should be dismissed immediately, and the prosecution should open a criminal investigation.
"Especially bearing in mind the existence of possible motives for this serious failure in work, which can lead to the compromise of large international operations of partner services", Medojević concluded.
