By appointing the director of the National Security Agency (ANB), Prime Minister Zdravko Krivokapić, by ignoring the legal competence of the Assembly, violated the Law on the National Security Agency, Art. 25 st 2 and 3, and made the Assembly a circus instead of a temple of democracy, said the vice-president of the Social Democratic Party (SDP), Bojan Zeković.
He said that the Government, by "unrecorded violation of the Law on ANB", shows its intention to operate beyond its constitutional position, and that due to the quarrel between the ruling majority, the collapse of the Assembly, its constitutional position and legal competences is on the scene.
"It is surprising that the President of the Assembly Bečić allows the dignity of the legislative chamber to collapse. The strong Assembly that strongly controlled the Government was once a 'parliamentary dictatorship', but its constitutional and legal competences had to be respected, while now Krivokapić is openly humiliating by appointing the head of the ANB without discussion in the plenum, even though it is an explicit legal obligation," announced Zeković.
Part of the parliamentary majority, as he said, instead of protecting the position and reputation of the Assembly, is trying to protect the Prime Minister and "his desire to ignore the Assembly," and "unfortunately, it allows him to humiliate it."
"We call on the President of the Assembly not to allow further collapse of the Constitutional position of the Assembly and to ensure respect for its legal powers, which are clearly prescribed in Article 25 paragraph 2 and 3, which oblige that the proposal for the appointment of the head of the ANB must be discussed at the plenary session," Zeković said.
The dispute within the ruling majority over the head of the ANB, the vice-president of the SDP points out, must not lead to the "constitutional and legal humiliation of the Assembly".
"For the DPS, the strong Assembly used to be a 'parliamentary dictatorship' and now the DF, the Democrats and the URA are turning it into a 'parliamentary caricature' with their quarrels. The President of the Assembly must protect the constitutional position, dignity and reputation of the Assembly," Zeković concluded.
