Ranko Krivokapić's pension was terminated, he must return the money received

The decision by which the former President of the Parliament of Montenegro Ranko Krivokapić exercised his right to a pension in the past eight months was annulled by a new Decision of the PIO Fund dated August 24 this year, which means that if his pension is terminated, Krivokapić will have to return the eight pensions paid to the PIO Fund, it says PCNEN.

"The decision of the PIO Fund of Montenegro dated August 24.08.2021, 108 annulled the decision recognizing the right to a pension to the former President of the Assembly, Ranko Krivokapić, and rejected as unfounded his request for the recognition of the right to an old-age pension in accordance with the provisions of Article XNUMX of the Law on Prevention of Corruption ", said the PIO Fund in response to PCNEN's questions.

From the PIO Fund, they add that after the finality of this Decision, they will initiate a procedure for compensation of damages and thereby request the return of the eight pensions paid so far.

"In the enacting clause of the Decision on annulment, it is stated that the 'Department for Normative Legal Affairs and Professional Assistance Services will initiate a procedure for compensation for damage caused to the PIO Fund of Montenegro', that recourse procedure will only be possible to initiate after the finality of this decision, when we will demand reimbursement eight illegally paid pensions", explained the PIO Fund.

Krivokapić's pension is about 2.000 euros

"If the decision had not been annulled, the damage to the Fund's budget would have been considerable, if we bear in mind that this was the second highest pension in Montenegro (it is slightly less than the highest pension, which is a little over 2.000,00 euros)". they said from the PIO Fund.

Three criminal charges were filed and one disciplinary proceeding was initiated

"Three criminal charges were filed, one of which was against one or more non-governmental persons employed in the Ministry of Labor and Social Welfare and two against persons with special powers in the PIO Fund. Disciplinary proceedings have been initiated against the decision-maker and the same person has been suspended until the suspension of the disciplinary proceedings or the statute of limitations, or if it is determined in the disciplinary proceedings that she did not violate her official duties," the PIO Fund notes.

"The new Management of the PIO Fund not only expects the support of other institutions in shedding light on this case and its judicial epilogue, but believes that the resolution of this case could represent a measure of justice and fairness in the process of exercising rights at the PIO Fund", said the Fund, responding to the question of PCNEN whether they expect support from other institutions and the court's epilogue from the PIO Fund.
