The Ministry of Defense is dissatisfied with the decision of the Special State Prosecutor's Office (STP) for not prosecuting the former minister Predrag Bošković (DPS) and two of his associates, who reported that they damaged the budget by about 32 euros with false invoices.
MO claims that SDT acted selectively. "The prosecution of one official, along with the acquittal of the official on whose instructions he carried out the abuse, does not lead to rights and justice," it was stated in the reply to the News.
Special prosecutor Sasa Cadjenovic dismissed the criminal complaint against MO Bošković and two former heads of directorates of that department Mihail Volkov i Alma Ljuljanaj Jovićević, in which it was stated that they damaged the budget by 31.220 euros with fictitious orders, through a travel agency.
The head of the Department of Finance in the MoD will be responsible for fictitious accounts Marko Drobnjak, against whom the proceedings are conducted by the Basic Prosecutor's Office in Podgorica - to whom the SDT assigned the case.
The Ministry, as written in its response to the News, confirmed the decision of the SDT and states that it will not file a complaint that would require a review of the decision. They add that "they will wait for better times and other prosecutors who will perform their duty honorably and in the public interest".
When asked whether a disciplinary procedure against Drobnjak was conducted in the Ministry of Defense due to fictitious orders, the answer states that "depending on the actions of the ODT on the subject criminal complaint, the possibility of initiating appropriate disciplinary proceedings against the appointed civil servant will be considered."
They added that there are two other disciplinary proceedings against Drobnjak, which have nothing to do with this case.
Minister of Defense Olivera Injac je at the end of June, she filed a criminal complaint for illegal spending of state money during the mandate of her predecessor.
Prosecutor Čađenović, in the explanation of the decision, which Vijesti had access to, stated that during the investigation process, in his capacity as a citizen, he interviewed several persons, among whom there were no Bošković and Volkov.
Also, according to SDT files, during the reconnaissance, he collected documentation of legal entities "Marco Polo travel agency", "VL Mobile", "2R Travel", "Athos real estate & apartments", Hotels Group Montenegro stars, Hotels Crna Gora and Savana continental property management and lodging - Hotel Ramada.
Drobnjak told the prosecutor that he was not in charge of providing hotel accommodation for foreign delegations, seminars, workshops...
He also said that on December 1, 2020, the Tourist Agency submitted an invoice for hotel accommodation in the amount of 4.620 euros, but that the Ministry of Defense has a need to provide hotel accommodation almost every day, which is why he made the payment. He gave the same explanation for the payment of seminars allegedly held in the hotels "Hilton" from July 15 to 18, 2020, "Splendid" from the 20th to the 23rd of the same month, and "Ramada" a few days later - from the 27th to the 30th of July.
The director of the "Marco Polo" agency admitted to the prosecutor that she did not organize those seminars, explaining that he wrote the invoice according to Drobnjak's instructions, and then transferred the money to the account of the "2R travel" agency. He explained the same for the payment of the overnight stay at the "Hilton" hotel, but also for the invoice they received from the company VL Mobile, which amounted to 5.511,5 euros.
The director of that company, however, claimed that they delivered electronic devices to the agency, and the director of "2R Travel", Radmila Bulajić, said that she collected the debt from the Ministry of Defense with invoices for seminars that were not held...
Although they established that the services that were invoiced were not provided, that Bošković and Volkov issued a certified order for payment, and Ljuljanaj Jovićević certified a statement that the service was performed, the prosecution did not find grounds to prosecute them.
Čađenović assessed that Bošković, Volkov and Ljuljanaj Jovićević, when they approved payment from the state account, could not know whether the services listed in the invoices were actually provided or not.
