The Democrats' committee club in the Kolašin Municipal Assembly (SO) sent an urgent request to the Administrative Inspection to act on the initiative to take measures of inspection supervision over the work of local self-government bodies in that city.
As it was announced, on March 17, the Democrats asked the Administrative Inspection for supervision in the Kolašin Municipality because, as they claim, the president of the SO Milan Đukić did not act "according to the explicit provisions of the Law on Local Self-Government". Due to, as they explain, "Đukić's actions according to the law, the function of president of the municipality of Kolašin is still performed by Bulatović, whose mandate has ended by force of law".
As a matter of urgency, the Odbonički club reminds that the Administrative Inspection has not yet acted on their initiative, nor have they been informed of the reasons for not acting. They remind that "in accordance with Article 199 of the Law on Local Self-Government, inspection supervision over the implementation of the provisions of the Law on Local Self-Government is carried out by the Ministry of Public Administration, Digital Society and Media, through the Administrative Inspection", according to the announcement of Democrats.
They also explain that "in accordance with Article 13 of the Law on Inspection Supervision, in carrying out inspection supervision, among other things, the inspector is particularly obliged to consider the initiative for starting inspection supervision and to inform the submitters of the initiative", as well as "to act lawfully, in a timely manner and in in accordance with the ethical code of civil servants".
"The inspection supervision that we initiated related to the implementation of the provisions of Article 65 paragraph 1 point 4 of the Law on Local Self-Government, which stipulates that the mandate of the President of the Municipality ends by operation of law when he is convicted by a final judgment for an act that makes him unworthy to perform his duties. Article 61 paragraph 2 of the same law prescribes that the termination of the mandate of the President of the Municipality, due to the resignation and by force of law, is established by an act of the Assembly", reads the urgency of the Democrats, which was signed by the head of the Club of Councilors and deputy of that party, Vladimir Martinović.
The Democrats claim that "it cannot be disputed that the judgment of the High Court in Podgorica Ks. no. 32/2020 of June 02.06.2021, 15.02.2022, by which Milosav Bulatović, the president of the Municipality of Kolašin, was convicted of the criminal offense of abuse of office became final on February XNUMX, XNUMX. years".
They also add that "it is indisputable that the president of the SO, at the session of the SO, held on March 14.03 and 15.03.2022, XNUMX, refused to act on the request of the Democrat councilor, that according to the delivered judgment of the Appellate Court, in accordance with the legal provisions, he states that Bulatović's employment has ceased by force of law mandate of the President of the Municipality".
Bulatović also informed the public that he will not resign from the post of mayor of the municipality of Kolašin, even though he has been legally convicted of a criminal offense that makes him unworthy to hold the office of mayor of the municipality. the function of the President of the Municipality is still performed by a person whose mandate ended on February 15.02.2022, XNUMX by force of law," the Democrats claim.
The Democrats urge "that the Administrative Inspection, in order to ensure compliance with the principles of legality in the work of local self-government bodies in the municipality of Kolašin, urgently carry out inspection supervision", as well as "that, based on the factual situation established in the minutes, issue a decision on measures, actions and deadlines for compliance provisions of article 65 paragraph 1 point 4 and article 61 paragraph 2 of the Law on Local Self-Government".
"Otherwise, we will be forced to take appropriate measures against all actors who, through abuse of their official position, enabled Milosav Bulatović to perform the function of the mayor of the municipality, even though his mandate for that function ended by force of law on February 15.02.2022, XNUMX. At the same time, we expect SDT to initiate and the procedure for reviewing the way the Administrative Inspection works as a whole," conclude the Democrats in Urgency.
