The President of the Municipal Board of the Democratic Party of Socialists (DPS) in Ulcinj, Driton Lunjić, said that "classic legal violence" and "the grossest abuse and overstepping of powers" by councilors in the Ulcinj Municipal Assembly took place today.
According to him, the Law on Local Self-Government and the Statute of the Municipality of Ulcinj were violated in the most gross way.
Lunjić announced that the oldest councilor presided over today's session and that, as two candidacies for the President of the Assembly were submitted, "he interrupted the session and scheduled a meeting of the clubs of councilors for Monday, in accordance with Article 51, paragraph 3 of the Statute".
"With the suspended session, Genca Nimanbeg took the chair without any provocation, thereby 'usurping' the position of chairman. In this way, both the criminal and the administrative legal dimension in this legal matter are opened", said Lunjić.
This means, as he said, that all decisions, starting with the election of the President of the Assembly and continuing, are illegal and in violation of the Statute and Rules of Procedure of the Municipality of Ulcinj.
"In this regard, we will launch an initiative on the evaluation of the legality of the competent court, the decision on the election of the President of the Assembly and all other decisions made by this Assembly", he pointed out.
As the president of the Ulcinj DPS committee announced, 19 councilors led by Nimanbegu "entered the zone of criminal responsibility by exceeding their powers and committing a criminal offense from Article 416, paragraph 1 of the Criminal Code of Montenegro", for which the Special State Prosecutor's Office is responsible.
Lunjić particularly emphasized the actions of the administrative inspector, who he said was an accomplice in "today's illegal action", because he "abused the authority" he has as an administrative inspector and who "completely illegally supervised a subject who cannot be a subject of administrative supervision" and on that occasion he "obviously acted on someone's orders and was supposed to be a repressive stick."
"We call on the competent prosecutor's office to take all further actions with the aim of prosecuting all responsible persons who have violated the law," concluded Lunjić.
In the end, as he said, the "complicity of members of the Police Administration" who provided assistance to the administrative inspector in the direction of verifying "the illegal decision on the election of the President of the Ulcinj Municipal Assembly that was passed by the illegal Assembly" is particularly surprising, so the question arises "according to whose order and for whose needs they were misused".
