"Since tomorrow you have to vote on the Proposal for the Law on Planning and Building Construction, and hoping that maybe some of you will gather the courage to listen to your conscience, we invite you not to vote for turning Montenegro into a farm of the powerful who intend to occupy every foot Montenegro from which they can extract profit. Through the Minister of Tourism and Spatial Planning, they want to uncontrollably tailor plans that will make Montenegro the prey of insatiable profiteers. Citizens of Montenegro, councilors, municipalities will no longer decide on the territory of Montenegro. We believe that it is clear to you that that is the goal of the Draft Law that they submitted to you to make it official, ignoring the appeals of the profession, civil society, municipalities and citizens," Abazović and Rudović wrote in the letter.
It is added that the members of the government are probably aware that this Draft Law violates fundamental civilizational and state documents such as the Constitution of Montenegro, the European Charter on Local Self-Government, the Law on Local Self-Government and the Charter on Spatial Planning, because it abandons the principle of decentralization and citizen participation. in space management.
"It promotes, as you probably read in Article 52 of the Draft Law, the previously unrecorded principle of expropriation of private property because it allows your neighbor to expropriate your land, if you do not want to sell it to him. Think about it because you are always hungry profiteers can hardly protect your parliamentary status," the letter reads.
Abazović and Rudović further state that with this Bill, the Ministry of Sustainable Development and Tourism (MORT) makes a decision on the land use plan of Montenegro, makes a plan, appoints auditors, implements the plan and is not accountable to anyone.
"Even if we ignore the obvious scope for corruption and various influences, imagine how feasible it is if you know that since 2011 the same MORT has been working on the Spatial Plan for the coastal area and has not yet succeeded in completing it. Along with sending the Draft Law to the Parliament prepared by-laws were also submitted to the municipalities (for example, a set of acts on legalization, on planning...) There are more than 50 of them, and many of them are very extensive. As soon as a law has so many such by-laws, it is the best indicator that it is bad and unenforceable. unless it is adopted for some other reasons. The by-laws did not go through a public discussion, so that is also one of the proofs of the lack of transparency of the process. Although the space planning process is a first-class professional job, here it is taken over by the executive body," reads the letter from Abazović and Rudović.
MPs of the GP URA also point out that the involvement of municipalities is argued by one representative in the development of the General Regulation Plan.
"But that is nowhere near enough for the participation of citizens and local governments. It is interesting that if, for example, Vodovod or Elektrodistribucija have objections to the plan, they are obliged to prepare and propose a new contribution within 60 days. This discourages any giving remarks. There is no such possibility of influence for municipalities," Abazović and Rudović state.
They state in the letter that the chairman of the Audit Council is appointed by the Ministry, and he chooses the team.
"The "city rent" prescribed by the local self-government was added, but only with the prior consent of the Government. The minister revokes the licenses of planners. The chief architect is untouchable, but he does not have to have a license as proof that he has done something and specialized. All these facts indicate that it is about the unacceptable and scandalous legal proposal, which points to the suspicion that its goal is to facilitate and speed up the yakulisa tearing up of the most valuable parts of the territory of Montenegro, such as Buljarica, Kraljičina plaža, Boka, Velika plaža, Solana, etc., promised by your leaders who knows to whom and under under conditions known only to them. As you know, your policy has devastated the whole of Montenegro and left it without an economy. The only thing we have left that can be a driver of economic development is space. If Montenegro takes its most valuable territory, it will become a divided colony by zones between domestic profiteers and their "strategic partners". You can still choose who you will serve. Your country or them," the letter concludes.
