Democratic Montenegro MP Danilo Saranović said that if the parliament adopts amendments to the Law on Amendments to the Law on Local Self-Government, it would mean that if the final results of the local elections are not announced within 60 days, the mandate of the local Assembly will end. That 60-day period, as he said, expires tomorrow in Podgorica.
He said at the press conference that the amendments were submitted by him, the vice-president of the Assembly and the official of the Movement for Change (PzP) Branka Bošnjak and the representative of the Civic Movement URA Miloš Konatar.
If the amendments are adopted, it could solve the crisis caused by the non-announcement of the final results for councilors in the Assembly of the Capital City on October 23.
The amendments provide that if the competent election commission in the local self-government unit in which the elections for councilors were held on October 23 of this year does not determine and publish the final results of the election by the date of entry into force of this law, the mandate of the assembly of the current convocation ends by force of law entry into force of the law.
It is also foreseen that the Government, by its act, states the termination of the mandate of the local parliament and appoints a Board of Commissioners at the proposal of the ministry.
The amendment envisages that the Board of Commissioners performs the function of the Assembly, until the publication of the final results of the local elections and the constitution of the new Assembly.
With that amendment, the president of the Board of Commissioners convenes the first session of the newly elected Assembly within 15 days of the announcement of the final election results.
"In order to create conditions for the smooth conduct of election processes, the exercise of citizens' right to local self-government, respect for the constitutionally guaranteed right of citizens to vote and be elected, in the event that the competent election commission does not determine or announce the final results of the election within 60 days from holding the election, this amendment creates the conditions for the deconstruction of the process and the confirmation of the mandate of the newly elected councilors", the explanation of the amendment states.
In the elections in Podgorica held on October 23, the list "Svi za naš grad", led by DPS, won 24 mandates, the Europe Now Movement 13, the coalition gathered around the DF 11, the Democrats six and the Civic Movement (GP) URA four . The Socialist People's Party, Preokret and Svetosavska are without mandates.
PES, DF, Democrats and GP URA have started negotiations on the formation of the government in Podgorica, which will send DPS into opposition in the capital after 24 years.
"These amendments, if they were to be adopted, would mean that when we have extraordinary circumstances that neither our legal system nor current practice recognizes, when you have a clear will of the citizens that is expressed in elections, and with one legal trick the representatives of certain political parties - in this case it is the representative of DPS and their high official (Veselin) Vukčević, who is the president of the Election Commission of the Capital City, decided on behalf of the entire commission to obstruct the effectuation of the electoral will of the citizens in the elections", said Šaranović.
He said that Ivan Vuković will be replaced by the councilors of the new convocation. Bosniak said that the amendments were the best way to unblock the situation in Podgorica.
"The fake mayor and usurper of the position still cannot believe that he will no longer be in that place and rushes into some decisions, first of all, where the money is." That is very interesting," said Bošnjak.
She said that soon a new government will be formed, as the citizens requested. "This is the most legitimate way and we expect the saga to end".
Konatar said that this is the only way to resolve the situation regarding the announcement of the election results, since all legal means used to try to get the election results of the local elections in Podgorica to be announced have been exhausted.
He pointed out that the amendments do not introduce compulsory administration in Podgorica, but specify what happens if someone, in this case the president of the election commission of the Capital City, does not comply with the majority of the members of the IKGG, the recommendations of the SEC and the election results for 60 days.
