The Party of Pensioners, Invalids and Restitution (PIR) has submitted a request to the Constitutional Court in which they request the annulment of the decision of the State Election Commission (SEC) to accept the candidacy of the leader of the Democratic Party of Socialists (DPS) Milo Đukanović for the presidential elections.
As stated in the request, which is signed by PIR president Momo Joksimović, Đukanović's third candidacy for president of Montenegro "grossly violates Article 97 paragraph 2 of the Constitution of Montenegro: 'The same person can be president of Montenegro twice at most'".
"This provision of the Constitution is clear to a lawyer and a layman that it does not need an interpreter. The decision of the Constitutional Court from 2013, which states that Montenegro has been cultivating legal discontinuity since 2007, is wrong and bizarre, meaningless and illogical and legally unsustainable. The decision of the Constitutional Court is both legally and politically unsustainable, where you can see the party affiliation of the judges of the Constitutional Court, who humiliated the Constitutional Court as the highest legal institution and the legal order of Montenegro. The judges of the Constitutional Court who voted for such a decision do not even deserve reach from the door of the Constitutional Court", it was stated in the request addressed to the Constitutional Court.
It is added, among other things, that the Constitutional Court is requested to annul the Decision of the SEC on accepting the candidacy of Đukanović for the presidency "which is in the interest of Montenegro and its citizens".
