The leader of the Europe Now Movement (PES) Milojko Spajić filed a lawsuit against the state of Montenegro, that is, the State Election Commission (SEC), for violation of voting rights and discrimination, "Vijesti" confirmed.
The SEC told "Vijesti" that they had not received the document.
In the lawsuit, which "Vijesti" had access to, it is stated that the SEC issued a decision on February 18 that does not determine Spajić's candidacy for the election of the President of Montenegro, thereby violating his right to vote.
As stated in the lawsuit, the SEC stated in its explanation that Spajić formally meets all the requirements for candidacy for the president of Montenegro, but that the evidence provided by the Republic of Serbia Election Commission shows that he deregistered his residence in Serbia the day before submitting his candidacy, and that he is still a citizen of another country.
In the lawsuit, it is added that in this way the SEC acted in a discriminatory manner towards Spajić in relation to other presidential candidates, and thus violated his right to vote and exceeded the powers granted by law.
"As Spajić fulfilled all the conditions stipulated by the Constitution and the law to be a candidate for the President of Montenegro, it is clear that the SEC violated his voting (passive) right," says the lawsuit filed by lawyers Ilija Jokić and Danilo Ćulafić.
They reminded that the Law on the Election of the President of Montenegro stipulates that the SEC determines the candidacies of presidential candidates.
"The SEC did not have the right to decide whether or not to recognize a particular right, but only to determine whether a particular candidate has the right to passively vote, and also solely from the evidence that the law stipulates must be submitted with the candidacy," the lawsuit states.
It is added that any other behavior represents exceeding the powers given by law, especially considering the assumption of the truth of the public documents submitted with the proposal for candidacy.
