The decision of the Constitutional Court on the repetition of voting at one polling station in Cetinje can further prolong the determination and publication of the final results of the elections held on June 11, the president of the State Election Commission (SEC) told "Vijesta" Nikola Mugoša.
He said this after the Constitutional Court accepted the appeal of the Social Democratic Party (SDP) by a majority of votes yesterday, so the elections will be repeated at one polling station in Cetinje - polling station no. 16, Lovcen partisan detachment II.
"Re-elections, in accordance with the law, are conducted within seven days at the latest, which will be decided by the Election Commission of the Capital," said Mugoša.
Female judges were against the adoption of SDP's appeal Snezana Armenko i Momirka Tešić, which singled out the opinion.
The remaining four appeals that were considered yesterday were rejected by the Constitutional Court. Three SDP appeals related to the election process in Bijelo Polje, Cetinje and Rozaje, as well as a voter's appeal, were rejected as unfounded. Ž. D. as illegal.
According to the provisional election results, the SDP was left without parliamentary status, because 2,9 percent of the voters voted for them, that is, they lacked about 300 votes to pass the census. 672 voters were registered at the Lovcen Partisan Detachment II polling station in Cetinje, and 11 of them voted in the elections on June 363, of which 125 voted for the Democratic Party of Socialists (DPS) and 122 for the SDP.
The SEC was supposed to announce the final results of the elections by midnight on June 26, but they announced that the legal conditions for that had not been met, as the deadlines for filing objections and appeals to the Constitutional Court are still running.
Yesterday, Mugoša said that the SEC decided on all submitted objections within the legal deadline of 24 hours, without delay.
"I note that the deadline for submitting complaints to the SEC is still running, as well as the deadlines for submitting appeals to the Constitutional Court. Bearing in mind that part of the complainants use their legal right to have the solutions sent to them by mail, this greatly affects the dynamics of work and decision-making of the election administration", he explained.
Repeating the election at the polling station in Cetinje returns the entire process of submitting objections to the beginning, that is, when the elections are held, new deadlines will apply.
After the Constitutional Court has ruled on all appeals against the election process, the SEC will be able to announce the final results. From the date of the announcement of the final results of the election, the period of 15 days for the constitution of the Assembly begins.
From the constitution of the parliament, the president of the state has one month to consult with the parties, after which he proposes a representative for the composition of the government, who, within 90 days, should form the cabinet and present the work program of the future executive power.
The Europe Now Movement (PES), which won the most votes in the elections, announced that coalitions and parties with which they share similar priorities and principles will be invited to form a government immediately after the announcement of the final election results.
In the elections, PES won 24 mandates, the "Together" coalition, led by DPS, 21 mandates, ZBCG 13 mandates, the Democrats and GP URA coalition 11 mandates, the Bosniak Party six mandates, and the coalition of the Socialist People's Party (SNP) and Demos two seats. The Albanian Forum also won two mandates, and one each for the Albanian Alliance and the Croatian Civic Initiative.
Another proof that the electoral law contains serious flaws
Nikola Mugoša points out that the situation with the delay in determining the final results of the election is not due to an omission or error by the SEC, but to the inconsistency of the provisions of the Law on the Election of Councilors and Members of Parliament, which refer to the deadlines for the publication of results, with the deadlines of the Law on Administrative Procedure, which refer to the submission of acts. and referred to by the Law on the Election of Councilors and Members of Parliament.
"It seems that this situation also showed that the electoral law contains serious flaws and inconsistencies that need to be revised. I hope that the electoral reform that is being announced will, among others, also treat this issue concerning the determination of the final results of the election. Given that the deadlines for submitting complaints to the SEC will soon expire, determining the final results of the election will largely depend on the decision-making dynamics of the Constitutional Court as the last instance in decision-making when it comes to election disputes," Mugoša underlines.
