The President of Prava Montenegro, Marko Milačić, today submitted a criminal complaint to the Basic State Prosecutor's Office in Podgorica against the acting president of the Democratic Party of Socialists (DPS), Danijelo Živković.
From that party, it was announced that the report was filed due to "grounded suspicion" that Živković committed a criminal offense - calling for resistance.
"Milačić filed a criminal complaint due to the fact that on October 19.10.2023, 18.10.2023, Danijel Živković, acting president of the political party Democratic Party of Socialists, at a press conference in a statement to the media, therefore publicly and to an unspecified number of people in advance, referring to the decision of the Main Board Democratic Party of Socialists on the boycott of the Population Census (which, as he said, was held on October 26, XNUMX), said: 'We hereby call on all citizens of Montenegro not to respond to such an illegally prepared population census and not to participate in such a fraudulent process , which was prepared by such institutions'. In this way, Danijel Živković called on citizens to boycott the upcoming population census in Montenegro, which is a direct and unequivocal reference to the violation of the Law on the Census of Population, Households and Apartments in accordance with Article XNUMX of this Law." Prava announced.
They claim that Živković committed a criminal offense - incitement to resistance, from Article 378 of the Criminal Code of Montenegro.
"Article 378 of the Criminal Code of Montenegro in paragraph 1 prescribes that whoever calls others to resist or to disobey the lawful decisions or measures of state authorities or to an official in the performance of an official act, shall be punished by imprisonment for up to three years; while paragraph 2 of Article 378 of the Criminal Code Code stipulates that if, as a result of the act referred to in paragraph 1 of this article, there is a failure to implement or a significant impediment to the implementation of a lawful decision or measure of state authorities, the perpetrator will be punished with imprisonment from six months to five years; in the described manner, Danijel Živković committed the features of the above-mentioned criminal offense, Milačić proposed that the basic state prosecutor, as competent, initiate criminal proceedings against Danijel Živković for the above-mentioned criminal offense," the announcement concludes.
