The State Commission for the Control of Public Procurement Procedures accepted the appeal of the company "Erlang" and canceled the decision of the company "Čistoća" that the company "Ađi invest" from Nikšić builds the first phase of the expansion of the Shelter for abandoned and lost pets and sent the case back for a new procedure and decision.
The tender for the first phase, which consists of the construction of 124 boxes for dogs according to the "turnkey" system, was estimated at 203.000 euros. In the decision of the state commission, which is signed by the president Zoran Živković, it is stated that "Čistoća" was ordered to remove the irregularities pointed out within 15 days from the adoption of this decision in a new procedure.
The decision of the commission obliges "Čistoća" to compensate the company "Erlang" for the paid fee for conducting the procedure in the amount of 2.030 euros and for the expenses for drawing up the appeal in the amount of 700 euros, within 15 days from the date of the final decision.
On July 170.154, "Čistoća" chose the offer of the company "Ađi invest" in the amount of XNUMX euros as the most favorable offer, while the offer of the company "Erlang" was rejected as incorrect.
On July 17, "Erlang" filed a complaint stating, among other things, that the offer of the company "Ađi invest" was incorrect, because their chief engineer did not have three but one year of work experience in the field, and that they offered sand of inadequate granulation.
The commission's decision states that "Čistoća" submitted answers to the complaint to the state commission on July 24, in which they point out that it is unfounded.
Against the decision of the commission, in order to determine its legality, an administrative dispute may be initiated by a lawsuit before the Administrative Court within 30 days from the delivery of the decision. The shelter at Vreli ribničke currently has 40 boxes - 30 open and 10 closed, for housing abandoned dogs.
