The final results of the local elections in the municipality of Budva were published in the Official Gazette on June 17. The constitutive session began, where the mandates of councilors were verified, but the head of parliament was not elected, which, according to the Law on Local Self-Government, means that the Assembly is not constituted.
In Andrijevica, new deadlines for the formation of the government have been running since the publication of the election results in the Official Gazette on July 16, due to an error by the Post of Montenegro.
Elections in Budva were held on May 26 and, according to the Law on Local Self-Government, the assembly must be constituted within 60 days from the announcement of the final election results, that is, by August 6 in Budva. If this does not happen, the President of Montenegro Jakov Milatovic will call new elections.
The formation of the government in Budva requires a majority of 17 councilors in the 33-seat parliament. The list "Budva our city", which he led Nikola Jovanovic, has nine councilors, "Clean election - SDP, SD, LP and citizens" Petar Odžić i Blaž Rađenović "URA - Dr. Dritan Abazović - Different", one each, which means that they have 11 councilors, and they are missing six, four Democrats and two PES.
The fact that the citizens of Budva, although they scheduled the constitutive session within the deadline, did not elect the head of the Assembly until July 7, 2024, that is, the fifteenth day after the day of convening, gives the Government the opportunity to schedule the session.
In the Information on the situation in the Assembly of the Municipality of Budva, which was adopted by the Government on Thursday, it is stated that the Ministry of Public Administration, after the final announcement of the results of the local elections in the Municipality of Budva on June 17, carried out administrative supervision regarding the application of Article 39 of the Law on Local Self-Government .
This article stipulates that the first session of the newly elected assembly is convened by the president of the previous assembly, no later than 15 days after the announcement of the final election results. The meeting of the assembly is held no later than 15 days from the date of convening.
If the session is not convened within the mentioned deadlines, the session will be convened by the Government, no later than 15 days after the expiration of the prescribed deadline for convening, that is, holding the session.
On July 8, the Ministry of Public Administration issued an administrative supervision report stating that the final election results in the municipality of Budva were announced on June 17, and that the constituent session of the Municipal Assembly was convened on June 22 for July 7.
"The first session of the newly elected SO Budva was called by the president of the Assembly of the previous convocation, with the proposed agenda and the information that the material for the proposed agenda item will be submitted at the session itself. The session was chaired by the oldest councilor, Savo Medigović. The first session of the newly elected SO Budva was interrupted because the proposal for the election of the President of the Budva Municipal Assembly was not submitted, as well as the fact that the councilors will be informed in a timely manner about further work", the information of the Ministry of Justice states.
According to the Law on Local Self-Government, the newly elected Assembly is obliged to hold a session of the Municipal Assembly within 15 days from the date of convening the first session of the newly elected convocation, which implies that the Municipal Assembly is constituted within that period, that is, the President of the Municipal Assembly is elected.
"Since the session was convened on June 22, 2024, for July 7, 2024, it had to be concluded by the constitution of the Municipal Assembly no later than July 7, 2024, that is, the fifteenth day from the date of convening," the Government information reads. "In the subject supervision report, the Budva Municipal Council was informed that this body will submit to the Government of Montenegro a proposal for convening a session of the newly elected Budva Municipal Assembly with one item on the agenda - the election of the President of the Assembly".
When it comes to Andrijevica, the Ministry of Public Administration supervised the implementation of the provisions of Article 39 of the Law on Local Self-Government in the Municipality of Andrijevica and found that the final election results were published in the Official Gazette on July 16. This week, "Vijesti" was told that the registered post with the final election results, addressed to the Official Gazette, was wrongly delivered to Radio Television of Montenegro, where it remained for more than a month.
The MJU notes that the deadlines for the constitution of the newly elected municipal assemblies start from the day of publication of the final election results in the Official Gazette of Montenegro.
"In this regard, the Ministry indicated to the secretary of the Andrijevica Municipal Assembly that it is necessary to take all official actions in order to organize the first session of the newly elected Andrijevica Municipal Assembly within 15 days from the date of publication of the final election results in the Andrijevica Municipality in the Official Gazette".
This means that the session of the local parliament where the mandates of councilors were confirmed from July 4th is not counted, but that it must be repeated and the deadlines for the formation of the government run again.
This extends the technical mandate of the current mayor of the municipality Željko Ćulafić.
MJU initiated the procedure of administrative supervision in Berane
The Ministry of Public Administration initiated the procedure of administrative supervision in the Municipality of Berane over the application of the provisions of Article 66 of the Law on Local Self-Government, which, among other things, stipulates that in the event of the termination of the mandate of the President of the Municipality, the election of the first man of the town shall be carried out within 30 days, and that the conditions for the dissolution of the Municipal Assembly have not been met.
In that municipality, the first attempt at an agreed rotation in the position of the president of the municipality failed. The election of Damjan Ćulafić from the Democrats, after two years when Vuko Todorović from the New Serbian Democracy was president, failed because two councilors of the former Democratic Front, Miloš Rmus and Milorad Đukić, did not sign their support for the election of Ćulafić, and then did not appear at the session of the local parliament neither did the other councilors from the majority.
The Ministry of Public Administration announced that the mandate of the President of the Municipality ends on the day of his resignation, from which moment the deadline for the election of the President of the Municipality begins in accordance with Article 66 of the Law on Local Self-Government.
It was announced from the MJU that the case files were delivered by the Assembly of the Municipality of Berana on July 17.
"The Ministry has started the supervision and will establish the factual situation as soon as possible and make a finding of the administrative supervision", announced the Ministry of Justice.
They announced that the conditions for the dissolution of the Assembly of the Municipality of Berana and the introduction of a board of trustees were not met.
