Lawlessness continues in the capital city with the illegal election of the acting (acting) director of the Administration for the Protection of Property and Legal Interests, the Club of Councilors of the Democratic Party of Socialists (DPS) of the Capital City announced today.
The Acting Director of the Administration for the Protection of Property and Legal Interests of the Capital City is Gojko Perović.
"The peak of legal ignorance or simply bad intentions of the current city management is reflected in the relationship with the Administration for the Protection of Property and Legal Interests of the Capital City of Podgorica. Namely, although the Law on Local Self-Government provides that the tasks of protecting the property and legal interests of local self-government units are carried out by an authority that determines municipality in accordance with the law, although the Statute of the Capital City, on the basis of the law, stipulates that these tasks are performed by the administrative body responsible for representation tasks, this is no longer the case in the Capital City," the statement of the DPS Councilors' Club points out.
They added that the capital Podgorica "should be an example of legal work and if it is necessary to initiate changes in laws related to the work of local administration, then when there are legal gaps or practice shows that adequate action and efficient work require new legal solutions".
"However, the Administration for the Protection of Property and Legal Interests of the Capital City has adopted a new Rulebook on the organization and systematization of workplaces, which stipulates that it is managed by the director, and the city is represented before the courts and administrative bodies by 'authorized persons'. The legal basis for its adoption is, as stated, the report on inspection supervision, where it is indicated that the post of deputy protector is not provided for by the Law on Local Self-Government", reads the press release of the Club of DPS Councilors.
They said that "given that the position of deputy protector is provided for by the by-laws adopted by the Assembly of the Capital City, based on the law, the current management, instead of protecting its integrity, by initiating amendments to the Law on Local Self-Government, completely deletes these positions for which required eight years of work experience and passed the bar exam".
"It is necessary to examine whether it is a matter of legal ignorance or a gross intention to cause damage to the city, by choosing new personnel solutions, given that the protector and deputy protectors no longer exist as jobs and legal representatives of the city, and the legal basis for passing an act it can only be the law, not the inspection record. In any case, it is clear to legal laymen that it is an illegal act, which must be subject to an assessment by the Constitutional Court of Montenegro.
They said that "the current solution is that the Administration of Property and Legal Interests is managed by a director, and the city is represented by authorized persons (a lower rank from the expert staff level of the Law on Civil Servants and State Employees), which positions imply less work experience and, according to the law, do not have the independence in work that the nature of the representative's work requires, it is clear that it is an intention to degrade this administrative body, and thus the position of the representative, by choosing new personnel solutions to the detriment of the quality of representation and potentially political influence on decision-making and legal opinions within the competence of this body".
"That there is a fear of the personnel and organizational collapse of another very important body is also indicated by the fact that the vacancy for the director of the Directorate for the Protection of Property and Legal Interests was announced during the election process, and as it is an extremely responsible position, it is not clear which job The experience and qualities of the current CEO, Mr. Gojko Perović, are recommended for this position.
