The State Election Commission (SEC) rejected today the objection of Vladimir Jokić, the holder of the list of Democrats and the Europe Now Movement (PES) in the recent elections in Kotor, who asked that institution to order the Kotor election commission to schedule a session and announce the final results of the voting in that municipality. .
The SEC made its decision after the Constitutional Court informed it that the appeal of the Democratic Party of Socialists (DPS) regarding the elections is still pending before that court.
SEC considered Jokić's appeal yesterday, but the session was interrupted because it was decided to send a letter to the Constitutional Court.
Jokić submitted the complaint on December 1 due to, as he stated, the failure of the Kotor Municipal Election Commission (MEC). In the complaint, he reminds that the MEC held a session at the beginning of November where it decided on the objections of the DPS for repeating the elections at polling stations number 17 - Prčanj and 28 - Mirac.
According to him, the MEC, by a majority of votes, first included on the agenda of the session proposals for decisions on annulment of elections at polling stations, after which it rejected the proposed solutions, and at the same session, by a majority of votes, also rejected the proposal for a decision on repeating the voting.
On November 5, the DPS submitted a complaint to the SEC about the decisions of the Kotor MEC, which rejected it as unfounded.
"Essentially, the SEC states that, given that there are no previous decisions in legal circulation on the annulment of the elections at polling stations 17 and 28 in Kotor, and as the MEC of Kotor rejected the decision on the annulment of the elections, therefore the legal prerequisites for repeating the elections have not been met at these polling stations," reminds Jokić, the current president of the Municipality of Kotor.
DPS filed an appeal against the decision of the SEC to the Constitutional Court, which did not make a decision, due to a "deadlock" position (three to three), that is, because a majority was not required to make a decision.
Jokić says that since there was no majority by which the Constitutional Court would amend or cancel the appeal decision of the SEC, by force of law it became final and enforceable.
He therefore suggested that the SEC approve the complaint and order the president of the MEC to schedule a session of that body, and to order the MEC to determine the final results.
According to the preliminary results of the elections in Kotor, held on September 29, the DPS and the Democrats-PES coalition won ten mandates each, the alliance "For the Future of Kotor", Grbljanska Lista and Democratic Alternative three each, the European Union two, and the Croatian Civic Initiative and the Kotor Movement per mandate.
