The President of Montenegro Jakov Milatović and the leaders of the parliamentary opposition parties - the Democratic Party of Socialists (DPS), the Civic Movement (GP) URA and the Social Democrats (SD) will meet tomorrow (Friday) at Milatović's invitation regarding the situation in the Constitutional Court, "Vijesti" has learned. from multiple sources.
The leaders of the other two members of the European Union (EU), the Social Democratic Party and the Liberal Party, were also invited to the meeting.
On Tuesday, the Parliament of Montenegro confirmed the termination of the duties of Constitutional Court judge Dragana Đuranović, so now there are five judges in that institution.
The opposition claims that this was a "constitutional coup" and Milatović that it remains unclear why the Constitutional Committee of the Assembly, "by creating different practices in the same legal matters, threatened legal certainty and illegally took over the jurisdiction of the Constitutional Court".
Milatović announced that he will announce a public call for the election of a judge of the Constitutional Court after that institution determines at the session that there are reasons for the termination of office or dismissal of the judge and informs him about it within the legal deadline.
According to the Constitution (Article 151), the Constitutional Court decides by a majority vote of all judges, which means that there must be at least four of them in office (out of a total of seven) and four judges must vote for the majority of decisions.
If a blockade were to occur in the Constitutional Court, the situation from the period September 2022 - the end of February 2023 would be repeated, when that court did not have a quorum for decision-making, because it was with three judges, that is, without four.
