Amendments to the Law on the National Security Agency (ANB) introduce anti-corruption integrity checks in that area for the first time, said Deputy Prime Minister Momo Koprivica, stating that this strengthens the filters for personnel selection.
Koprivica said that the Proposal for Amendments to the Law on the National Security Agency, which was supported by the Legislative and Security and Defense Committees, is on the agenda of tomorrow's extraordinary session of the Parliament.
He said he was confident that the law would be adopted despite, as he stated, anti-European attempts to obstruct the work of the Parliament.
"This draft law introduces reform innovations in terms of controlling the legality and efficiency of the work of the ANB, eliminates legal gaps and strengthens accountability mechanisms," said Koprivica.
He pointed out that a new institute of a special controller has been established, which will meet the needs of proper, responsible and timely control of the legality and efficiency of the work of the ANB.
"Instead of the existing institute of the Inspector General, which was neither precisely nor completely regulated, which is why we had abuses and negative selection of personnel in the previous period," added Koprivica.
He also pointed out that, thanks to the latest changes, the special controller responsible for controlling the legality and efficiency of the ANB's work will be a more objective and impartial mechanism, as it will be placed outside the internal organization and systematization of that institution and will have a clear place in the government system.
"The existing institute of the Inspector General does not have any specific reasons for dismissal prescribed in the Law on the National Security Agency, as a lex specialis, which calls into question his elementary responsibility for his specific job," said Koprivica.
According to him, the proposed amendment to the Law introduces special reasons for dismissing the Inspector General, if his actions have jeopardized or could have jeopardized the data collected by the ANB.
"Which is of particular importance for the prevention of abuse and the very responsibility of this very important authority holder," said Koprivica.
He said that it was solely because of this inadmissible legal gap that certain individuals won disputes, and not because, as he stated, the arguments were on their side.
Koprivica also pointed out that the proposed amendments to the Law on the National Security Agency introduce anti-corruption integrity checks in this area for the first time. "In this way, the filters for the selection of worthy personnel with integrity are strengthened, and in this way, step by step, we are imbuing the entire system with anti-corruption measures," said Koprivica.
He said that this legal amendment finally establishes clear rights, duties, responsibilities and earnings coefficients for this labor control holder.
According to Koprivica, valid legal solutions strengthen the system.
"These are basic steps in the field of institutional healing, and they are of particular importance in this area, bearing in mind the abuses, irregularities and negative selection of personnel that we have often seen in the past, with incalculable harmful consequences for democracy, national security, human rights and society as a whole," concluded Koprivica.
