The Government of Montenegro cannot schedule a new constitutive session under Article 39 of the Law on Local Self-Government because it is not possible for the Government to schedule a constitutive session twice, just as it is not possible to appoint someone to the same position twice, to inaugurate twice, and the like. Namely, the constitutive session was scheduled by the Government of Montenegro, precisely at the proposal of the MPA, for January 10, 2025, it was opened, adjourned, and the MPA announced that it had ended," the coalition points out.

As they emphasize, by acting in this way, the MPA has led the Government into a legal problem.

"And this was done when, apparently in political collusion with Jovanović, members of the DPS and SDP, all under the patronage of Drešaj and other members of his clan, realized that Savo Medigović, as the oldest councilor of the Budva Municipal Assembly who had resigned and after her withdrawal, no longer had the right to lead the session, and we believe he had no desire to participate in the deception of the electoral will of the citizens of Budva, but his place was taken by the next oldest councilor among those present in the hall. The constituent session of the Budva Municipal Assembly was deliberately declared closed by the MPA in order to give Nikola Jovanović and his group the opportunity to have councilors from the list supporting the proposal to elect Petar Odžić as the president of the Municipal Assembly resign in order to have a new oldest councilor from the URA list, or another person, who will lead the Assembly session, because it is clear to everyone that after Savo Medigović left the session, that right belongs to the councilor from the list 'For the Future of Budva - Budva Must Move Forward', Krsto Rađenović, "they point out from "For the Future of Budva" and add:

In addition, the MPA is acting contradictory, since in the Information from July 2024 it states regarding the holding of the session of the Budva Municipal Assembly after the elections in May 2024 - 'In this regard, the Ministry of Public Administration has drawn up an administrative supervision finding, number 01-043/24-3315, dated July 08, 2024, which stated, among other things: "In accordance with the provisions of Article 39, paragraph 2 of the Law on Local Self-Government, the newly elected Assembly is obliged to hold a session of the Municipal Assembly within 15 days from the date of convening the first session of the newly elected convocation, which implies that the Municipal Assembly is constituted within that period, i.e. the President of the Municipal Assembly is elected'. Which implies the following, the Government scheduled a constitutive session, the president was supposed to be elected within 15 days from the date of convening, which did not happen and the constitutive session was completed (as the MPA stated). Therefore, attempts to reconvene the session of the Budva Municipal Assembly are legally absolutely unfounded, they are not in accordance with the Law on Local Self-Government because not only is it not possible to convene a constitutive session twice, but when a constitutive session is convened, according to the MPA's interpretation, it must be completed within 15 days, which in this case is not possible since the MPA declared it completed.
