The Venice Commission has confirmed that the procedure stipulated by the Constitution was not followed during the retirement of Constitutional Court judge Dragana Đuranović, said President Jakov Milatović.
This, he says, clearly confirmed the position he once took on the issue.
Milatović says he is concerned about the "lack of responsibility" of decision-makers who were not prepared to hear the arguments for something that was "obvious from the beginning."
"I am also concerned about the attempt to interpret the position of the Venice Commission according to daily political needs, because that position is very clear. The procedure can be carried out either in accordance with the Constitution or contrary to the Constitution, and the Venice Commission has clearly stated that in this case the Constitutional procedure was not respected," Milatović wrote on Iks.
In this way, as he said, legal certainty and the uniform application of law were called into question from the highest state addresses.
It expects the competent authorities to carefully consider the recommendations of the Venice Commission, including the "clear positions" of the European Commission expressed in the non-paper on the rule of law, and to begin their implementation as soon as possible.
"Only through consistent respect for the Constitution and the law can we ensure the stability of the legal order, the protection of the independence of institutions and the completion of Montenegro's European path," said Milatović.
