At the moment when all formal prerequisites have been met, we have called on the Prime Minister to - in accordance with Article 3 of the Agreement - without delay take concrete institutional steps to fully implement the opinion of the Venice Commission, said Dr. Damir Šehović, President of the Social Democrats of Montenegro (SD) and one of the leaders of the European Alliance.
He reminded that yesterday the signatories of the March 15 Agreement sent a joint letter to the Prime Minister.
"The agreement is neither a form nor a protocol – but an assumed responsibility. It clearly defines the sequence of actions and obligations of all signatories. The opinion of the Venice Commission must not be ignored, especially considering that it was requested by consensus and accepted as a key instrument for preserving the constitutional order," Šehović pointed out.
According to him, at a time when it is indisputable that the Parliament has violated the Constitution, or rather the procedure prescribed by the Law on the Constitutional Court - which directly threatens the legal certainty and institutional integrity of the highest judicial instance - the only responsible move is the unconditional and urgent implementation of the opinion of the Venice Commission.
"Decisions made contrary to the Constitution must be repealed no later than 15 days from the date of delivery of the opinion," Šehović stated.
Šehović said that the Prime Minister is obliged to act in accordance with the obligations undertaken and ensure the conditions for the legal, legitimate and constitutionally based work of the Constitutional Court.
"Respect for the agreement, which is also guaranteed by the EU Delegation to Montenegro, represents a fundamental test of political maturity, European responsibility, but also of the personal seriousness of all signatories," concluded Šehović.
