The former president of the State Election Commission (SEC) and newly elected judge of the Constitutional Court (CC), Nikola Mugoša, has resigned from that position.
It was published on the website of the Assembly.
In the decision, he stated that, given that he was appointed as a judge of the Constitutional Court, he cannot, under the Constitution, hold a parliamentary or other public office or perform any other activity.
Also, in the decision that Mugoša submitted to the head of parliament Andrija Mandić, he referred to the Law on the Election of Councilors and Representatives (Article 121a, paragraph 2), which stipulates that the mandate of the SEC president, members and their deputies lasts until the election of the Central Election Commission (CEC).
"Given the aforementioned constitutional and legal provisions, as well as the fact that the Parliament elected me as the President of the SEC on December 8, 2021, and that at the Seventh Session of the Second Regular Session, I was elected as a judge of the Constitutional Court on December 31, 2025, I inform you that I am resigning from the position of President of the SEC," he said in the decision.
Mugoša also took the opportunity to thank the parliament for its support to the SEC in the previous period, as well as for the trust shown during the election as a judge of the Constitutional Court.
He was elected as a judge of the US, at the Assembly session held on the last day of last year.
61 MPs voted for his election, while four abstained.
Mugoša graduated from the Faculty of Law, and received his master's and doctoral degrees on topics related to the electoral systems of Montenegro and the EU.
His biography, published on the SEC website, states that he was a teaching associate at the University of Montenegro and a legal advisor at the SEC for six years. He is the author of several scientific papers, articles and texts on the topic of elections and a participant in several observation missions.
Since 2025, he has been an alumni of the prestigious International Visitor Leadership Program (IVLP) of the US State Department, intended for the exchange of experiences of prominent professionals and leaders from various fields of public life.
He was elected to head the SEC in December 2021.
