It is unacceptable that, despite the attacks that have become a continuity, judge Sava Mušikić assessed that the attackers of the Democratic Party of Socialists (DPS) councilor in the Nikšić Municipal Assembly (MA) do not deserve detention, the DPS Nikšić Municipal Board announced today.
"Judge Sava Mušikić's decision to allow suspects in the attacks on Nikšić Municipal Assembly member Rajko Perović to defend themselves from freedom has caused outrage and serious concern. Despite, as presented to the public, the existence of clear evidence and the prosecution's request for detention, the court made a decision that rightly raises the question among citizens whether the safety of our colleague and his family was seriously considered at all," the Nikšić DPS statement said.
They added that "in addition, the Montenegrin public should not forget the fact that this is only one in a series of attacks, and that the attacks on Perović and his family are becoming a continuity, which is unacceptable and requires an adequate attitude from the authorities, which was clearly absent this time."
"Additional weight would be added to the entire case if it turns out to be true that Judge Mušikić is an acquaintance of one of the suspects, without having requested a disqualification. Precisely in order to preserve public trust in the judiciary, we expect the competent authorities to investigate all the circumstances and remove any doubt about the impartiality of the decision-making. How effective the restraining order was was best seen when, after the attack on Krupac and the police warning, the suspects came to the family home of councilor Perović, and then attacked him and his family in the family business with heinous threats, some of which were even made in front of police officers. All of this is stated in the record and there is irrefutable evidence for all of it, but obviously Judge Mušikić does not care about the safety of our councilor," the DPS Nikšić statement reads.
They said that Mušikić would be solely responsible if the safety of councilor Perović and his family was threatened again.
"If we take into account the health condition of councilor Perović and that even a verbal attack can have fatal consequences, then it is clear what responsibility Judge Mušikić has taken upon himself. We expect the prosecution to take all necessary measures as soon as possible and file an appeal, in order to correct this shameful decision of Judge Mušikić. With this decision, this judge has sent a message that anyone can be attacked without consequences for their political activities and that he does not care about the safety of Councilor Perović and his family," said the Nikšić DPS.
They call on institutions to take good care of this case and to evaluate only the evidence and the facts.
"And we will inform our international partners of all the details and the court's actions. If the institutions do not do their job to the end, it will be a clear signal that we are left to ourselves and that we will have to organize ourselves to protect each other," the statement from the DPS Nikšić Municipal Board states.
The Police Directorate (PD) announced on July 8 that the Nikšić police had arrested three people on suspicion of committing two criminal acts endangering the safety of councilor in the Nikšić Municipal Assembly Rajko Perović and his brother Ž. P.
As the UO announced at the time, their officers in Nikšić deprived IB, Ž. D. and NG from Nikšić of their liberty.
