This can be unequivocally concluded from the minutes of the urban planning inspector Bisera Alihodžić, who at the end of 2014, carried out an inspection based on an anonymous report and stated that the main project on the basis of which the building permit was issued was not prepared, i.e. revised in accordance with the planning documentation and the issued urban planning and technical conditions, which the Municipality issued to itself. The inspector determined that it was a state property that was made available to the Municipality in the scope of rights 1/1.

The municipality started the construction of the facility, which has been surrounded by controversy since the beginning, because the locals and some politicians openly suspected that it was about business premises, and not parking lots with urban greenery, parks and a playground for children, three years ago without previously obtaining a building permit. The leader of the Democratic Union of Albanians, Mehmet Zenka, assessed at the time that the design of the building did not meet its purpose.

"Just look and you'll see that it's not a parking lot, it's business premises. For years, this government has been working only in the interests of ten or fifteen families. And they are setting this up for one of them. They will lease or sell it to someone, and that someone will ask for conversion and will probably get it with the support of the majority in the parliament, and that way that someone will profit from the square of the parking lot to the square of business space in the most beautiful part of Pristan", said Zenka at the time.

The current president of the municipality, Nazif Cungu, who was also the first person in the city when the tender was announced, replied to Zenka at the time that the work surrounding the construction of the parking lot was completely legal and transparent.

"Everything was done according to the law and in accordance with the Spatial Planning Program. Those people who are talking about it now voted for it, but it's obvious that they didn't read the material," Cungu said at the time.

The designer was the municipal Agency for Construction and Development, and the contractor was the company "Temko" from Nikšić. The permit was issued in May 2014 by the Secretariat for Urban Planning and Spatial Planning at the request of the Secretariat for Communal Activities. It is interesting that the leading designer on the project who worked at the Agency in 2013 and the secretary for urban planning who issued the permit a year later are one and the same person - a high-ranking official of the Force and the current secretary for communal activities, Mustafa Gorana. Despite the issued permit, work on the construction site was not continued because the request to increase the value of the investment from around 100 to another 50 euros did not go through with the then President of the Municipality, Fatmir Đeka.

On eight pages of the minutes, Alihodžić established in detail that the Municipality did not respect planning documentation or urban conditions.

The main project was created in August 2013, and the audit was carried out by the company Plan from Ulcinj two months later. The inspector found that the investor exceeded the dimensions by 234 square meters and instead of working on one, he extended it to parts of five more cadastral plots.

"The main project envisages the construction of staircases and garages, which is not in accordance with the prescribed urban planning conditions that prescribe the construction of open-type parking spaces. The construction of the staircase is not even planned in the planning documents", the inspector stated.

On the sign on the deserted construction site, which is still standing, it is written that the investor is the Municipality of Ulcinj, and the lead designer is the Agency for Construction and Development of Ulcinj. At the time, it was written on the board that the works would be completed on March 4, 2014. The deadline is no longer on the board, but above it still stands the conceptual solution of the project.
