The Agency for the Prevention of Corruption reached a conclusion by which it suspended all initiated proceedings initiated by the former Commission for the Prevention of Conflict of Interest against Montenegrin notaries, the Notary Chamber of Montenegro announced.
"On January 23, 2015, the Commission for the Prevention of Conflict of Interest passed a decision declaring notaries public officials. The Chamber of Notaries of Montenegro and all Montenegrin notaries announced the said decision and initiated proceedings to annul it before the Administrative Court of Montenegro. The Agency for the Prevention of Corruption as an independent and independent body, established by the Parliament of Montenegro, headed by Sreten Radonjić, took over the legal responsibilities of the Commission for the Prevention of Conflict of Interest from January 1, 2016. The Agency acts in relation to the rights and obligations of public officials and applies the new Law on the Prevention of Corruption ("Official Gazette of Montenegro No. 53/14)," the announcement of the Chamber of Notaries states.
It is added that considering the decisions of the Commission for the prevention of conflicts of interest regarding notaries, the Agency is of the opinion that the initiated proceedings cannot be continued and took the position that notaries are not public officials in accordance with Article 3 of the Law on Prevention of Corruption.
