Tomorrow, Montenegrin notaries will provide free legal advice to citizens in 14 municipalities and introduce them to the role of notaries in probate proceedings. The Chamber of Notaries of Montenegro (NKCG) will, on the occasion of marking four years of work, on April 29, traditionally organize the Open Day of the Montenegrin Notary. NKCG invites citizens who have dilemmas or questions regarding the acquisition, transfer, limitation and termination of property rights and other real rights on immovable property, their registration in the real estate cadastre and public registers to visit the notary's office on Wednesday, where they will receive free legal advice on the method and the procedure by which they will protect their rights and interests. "The goal of this action is also to bring the role of notaries in probate proceedings closer to citizens, because by amending the Law on non-litigation proceedings, the legislator transferred the management of undisputed probate cases from the courts to notaries, with the intention of speeding up probate proceedings and simplifying the procedure for citizens," it says. in the announcement. As stated, unlike other cases concluded before notaries, in which citizens freely choose a notary, in probate proceedings the necessary documentation is submitted to the Basic Court, which delivers them to notaries who have their official seat in the area of that court, in alphabetical order of personal name notary. The notary will conduct the procedure in the same way as the Basic Court has done so far, with the obligation to conduct it within 60 days from the receipt of the case. "After the finality of the decision ending the procedure, the notary will certify the finality and return the file to the competent court. An objection can be filed against the decision made by the notary within eight days from the delivery of the decision to the parties," the NKCG states. The objection is submitted to the notary, who is obliged to submit it without delay together with the case files to the court that entrusted the case to him. The judge of the first instance court decides on the objection. "In the performance of entrusted work, the notary is authorized to obtain the necessary data and documents from other competent authorities without paying fees, which will contribute to the reduction of costs, considering that until now this has been done by the parties," the statement says. It is stated that the notary is authorized to charge a fee for work in probate cases, according to the Tariff on fees for the work of a notary as a court trustee in probate proceedings. "When determining the remuneration for the work of a notary in probate proceedings, care was taken to ensure that citizens do not pay more than they paid in court, that is, the remuneration will be the same as it was in court", announced the NKCG. On the occasion of the fourth anniversary of the introduction of notary in the legal system of Montenegro, representatives of the NKCG will visit the newly established Public Institution Day Center for Children and Youth with Disabilities and Developmental Difficulties tomorrow and hand over a donation of two thousand euros.
