Mirko Radojević from Gornji Brezan in Piva claims that the Montenegrin Electric Transmission System (CGES) has announced that tomorrow, with the assistance of the police, they will enter his property for work on the 400 sq.m. transmission line.
"I will not allow CGES workers to enter the plot that is my property. I will be there with my family, friends and locals. I will defend my property with all available legal means. This is just one more in a series of violations of my basic human and civil rights by this energy companies and I informed all Montenegrin institutions, international organizations and the media about everything," Radojević points out in the press release.
According to him, the plot on which CGES intends to carry out works is not covered by any act of expropriation, complete or incomplete, and the police assistance in his case is illegal and represents "abuse of official position" by the person who approved it.
According to Radojević, the CGES refers to the Decision on a temporary measure, which, he claims, was passed by a judge of the Basic Court in Niksić, contrary to the law, while previously the Directorate for Real Estate, regional unit of Plužina, according to him, passed an illegal Decision on incomplete expropriation for road across njrg's plot to the pillar place.
"All decisions on incomplete expropriation in Piva are null and void because, first of all, they do not contain a deadline or an obligation to return the user to the original state, which is the essence and basis for incomplete expropriation. In my case, conversion was also carried out against the law and without my consent and notification of land from the forest to the road, and the subdivision of this part of the land has not been done either, but it is only stated "over the parcel", which makes the complete solution unenforceable", asserts Radojević.
He points out that CGES expropriated 154 square meters of his plot, out of a total of 6.000 square meters, and that they have completely destroyed the entire plot with the work done so far.
