No one could have guessed that the brilliant performance of the ballet troupe Nissan Native Acting studio from Tel Aviv, from 2008, would turn into a multi-year court case due to which an employee of a Budva public institution could find his family on the street.
Five years ago, the Israelis delighted the audience of the Grad Theater, and the story of the ballet and the marathon court case began when they were short-handed - JU "Grad Theater" owed them the cost of air transportation to the Budva summer festival.
After performing as part of the Grad Teatr student program, the ballet group, about 20 of them, as many as came to Budva, headed back to Israel. In the contract, which they concluded, in addition to the fee for the performance, which amounted to about three thousand euros, Grad Teatar also undertook to bear the costs of return air tickets between Tel Aviv and Dubrovnik.
However, after they returned to their native Israel, at the expense of the prestigious ballet school, they could not "lay down" the payment from Budva in the amount of 15 thousand euros that they paid for the air transportation.
And then it all started. Having requested the help of its embassy in Podgorica, the ballet troupe insisted that the citizens of Budva settle their obligations. However, it was at that time that Budva fell into the biggest financial crisis, the consequences of which are still felt.
The account of the Municipality, which is also the founder and financier of the Public Institution "Grad Teatar", was blocked. Since the Israelis' negotiations with Budva did not bear fruit, despite the mediation of diplomatic representatives, they folded the sheet.
A long-term court case followed, which ended on Friday with a court verdict, to sell a 47-square-meter apartment in Budvanska polje, which is held at JU "Grad Tetar", in the name of debt owed to the ballet troupe, and from that they are compensated.
According to the cadastral records of the Real Estate Administration on cadastral plot 1261/1, there is only one apartment of 37 square meters in the "Grad Teatar" public housing estate, which is also the only real estate owned by a public institution in its own name.
To make matters worse, the Adrović family, a family of workers employed at "Grad Teatr", has been living in that one-room apartment for a full decade.
Judge Sanja Čanković, as stated in the verdict, which "Vijesti" had access to, made a decision on the sale of real estate, through oral public bidding, namely a residential area of 47 square meters at a starting price of 75 euros.
Čanković scheduled a hearing for the sale of the apartment for March 7, and invited all those interested who have the right of first refusal to appear in court that day for the scheduled bidding.
The lawyer of the Israeli troops, Dejan Ćosović, who represented them in the civil proceedings, told "Vijesti" that he is not authorized to make statements in connection with the court case.
After the court ruled in favor of the ballet troupe, the only way he could indemnify them was through the sale of real estate that was registered to JU "Grad Teatar", because by law a public institution cannot have its own giro account, in order to the blockade was carried out and the debt was forcibly collected.
In this way, Adrović is threatened with eviction, if the Israelis persist in their intention to buy real estate at a minimum price, and compensate themselves, and pay the rest of the money to a public institution.
However, there is still a chance to reach an agreement, which was also left in the verdict by Judge Čanković, stating that "Nissan Nativ Acting Studio" and "Grad Teatar", as stated during the entire public bidding process, can agree on the sale through a non-comparable bargain and conditions of sale.
"If the real estate is not sold at the first public auction, the court will schedule a second auction at which the apartment can be sold below the established value, but not below 50 percent of that value. If even then the apartment is not sold, the court can schedule an auction at which it can be sold below the set price," the verdict states.
Smailagić believes that the Municipality will pay
The executive director of JU "Grad Teatar" Merin Smailagic is convinced that the apartment will not be sold, because the Municipality's account has been unblocked and thus created the possibility to settle the debt to the Israelis.
"There is an obvious debt to the Israelis for hosting our festival. They started the mechanisms for collection in court and in that process they demanded collection through the assets that are managed at JU "Grad Teatar". I believe that now, when the account of the Municipality that finances our institution is not blocked, we will quickly settle this obligation and pay the outstanding debt. With that, the need for collection through the sale of property ends," Smailagic told "Vijesti".
