The notary office in Nikšić of Ljubiša Marković and in Podgorica of Mira Bogić were sealed for several months after the controls were carried out.
"The Ministry of Justice, in accordance with its legal powers, during the first year of operation of the notary service, carried out regular supervision in all notary offices. In addition to regular supervision, we also carried out extraordinary supervision in five notary offices based on submitted petitions and criminal charges. During extraordinary supervision, "The ministry found a violation of official duty by one notary in Nikšić and one notary in Podgorica and submitted to the competent body of the Chamber of Notaries a proposal for conducting disciplinary proceedings with a proposal for their temporary removal from notary duties," the Ministry of Justice informed "Vijesta".
The proceedings against the notary in Nikšić have been completed and a disciplinary measure has been imposed on him - temporary deprivation of the right to perform notary duties for a period of 10 months, and for another notary from Podgorica, the Disciplinary Commission of the Chamber of Notaries issued a Decision on temporary removal from notary duties for two months .
During the extraordinary supervision, the other three notaries were not found to have the necessary elements for conducting disciplinary proceedings.
"Vijesti" learned that after the inspection, a temporary measure was adopted to suspend notary Mira Bogić for two months and Ljubiša Marković for ten. The decision on the temporary measure against Bogićka is valid from November 12 this year, while the decision for Marković was made in August.
According to "Vijesti" information, the Commission found that Mira Bogić worked outside the regulations from October 21, 2011 to October 13, 2012 because she made 11 notary records for ten apartments and one office space in the building owned by Vladan Nicović, which has only eight apartments.
After a temporary ban on practicing notary work has been determined, with the explanation of protecting the interests of legal security of citizens, disciplinary proceedings will be continued against her to determine whether she has personal responsibility in connection with the "sale of apartments".
A group of Podgorica residents filed criminal charges against Nicović, who built a building in Donja Gorica and sold the same apartments several times. The building with eight apartments is not yet finished, and so far as many as 16 buyers have appeared. A criminal complaint was also filed against notary Bogić.
Due to non-compliance with the decision of the Municipal Assembly of Nikšić from December 14, 2011, that the contracts for the state project "1000+1" apartment be made by all notaries from the list of the Chamber, the notary Lidija Klikovac was fined in the amount of three judges' salaries.
