They proposed to Marković to pass the Law on Same-Sex Unions

The expert working group for the preparation of the analysis of legal regulations from the aspect of LGBT rights proposed to the Deputy Prime Minister Duško Marković the adoption of a law on the rights of partners in same-sex unions.

The working group, consisting of: Tea Gorjanc-Prelević, Ivan Krkeljić, Nataša Pešić, Orhan Šahmanović and Zlatko Vujović, proposed to Marković the adoption of a legal act that would equate the rights of persons of homosexual orientation living in the community with the rights that Montenegro recognizes for partners living in extramarital union.

They presented this proposal to the Deputy Prime Minister just before the "Together Against Discrimination" conference, which will be held on Monday in Bečići, adding that the following countries already have laws on same-sex unions in Europe: Croatia and Slovenia, Andorra, Austria, the Czech Republic, Denmark, Finland, France, Germany, Hungary, Iceland, Luxembourg, Switzerland, Sweden and Great Britain.

They presented the proposal to the Deputy Prime Minister just before the "Together Against Discrimination" conference, which will be held on Monday in Bečići.

The working group, in addition to passing a law on same-sex unions, proposed, when it comes to the rights of transgender persons, prescribing the conditions and procedure for changing the gender marking in registers and personal documents: "The Act on Registers and the Act on the Central Population Register should be amended and if necessary, adopt the corresponding by-law".

The members of the working group, as written in the document addressed to Marković, did not have a unified position in relation to the amendments to the Criminal Code:

"It was agreed that the proposal for amendment action in the direction of supplementing certain articles of the Criminal Code, which now explicitly prohibits inciting and inciting only racial hatred, will be considered later, so that the prohibition will unambiguously include other forms of hatred based on discrimination, and hatred against sexual minorities and transgender persons".

"The European Commission against Racism and Intolerance (ECRI) in its report on Montenegro recommended that racist motivation be explicitly prescribed as an aggravating circumstance in connection with the commission of any criminal offense. This would include hatred towards sexual minorities and transgender persons, in accordance with the Recommendation of the Committee of Ministers of the Council of Europe to member states on measures to combat discrimination based on sexual orientation or gender identity," the document reads.

Members of the working group also recommended the introduction of a special article in the Law on Prohibition of Discrimination entitled "Meaning of terms used in this law", which would define the terms "gender identity" and "sexual orientation", in order to facilitate the application of the law and ensure its uniform application. application.
