"Among the candidates or appointed notaries are, among others, one judge of the High Court in Podgorica, one misdemeanor judge from Podgorica and 15 lawyers. The other appointed notaries are employees of other bodies," announced the spokeswoman of the Ministry of Justice, Ana Radusinović.
Notaries are authorized to draw up public documents on legal affairs, wills, to draw up records and certificates on all indisputable legal facts and to certify signatures, transcripts and other data. The story of notaries began in 2004 with the announcement by the then Minister of Justice Željko Šturanović that the first notary stamps would be struck in mid-2006. The Chamber considered that this is an attack on the work of lawyers and that the state is enabling the creation of a monopoly in favor of which millions of euros are waived in the name of paying fees and other obligations when certifying documents at Montenegrin courts.
"Legal decisions that a notary prepares, confirms and certifies legal transactions on the transfer of real estate, mortgages and leasing relieve, in essence, only the judicial notarization service and the court clerk, and not the judge, as it is wanted to be presented to the public," warned Vujanović at the time. .
The ministry claimed that the introduction of notaries will relieve the courts and administrative bodies and protect the interests of citizens and legal entities. One notary was to be appointed for every ten thousand citizens.
"The notary tariff is determined by the Assembly of the Chamber of Notaries with the prior approval of the government. Until the adoption of the notary tariff, the notary will calculate his fee for work in the amount of 50 percent of the amount determined by the law regulating court and administrative fees," said the spokeswoman of the Ministry of Justice.
The first notaries worked in the Kotor State Archive, which was established by the Government of the People's Republic of Montenegro on November 30, 1949. Their duty was to keep official property books, and they are considered the first archivists in the territory of Montenegro.
