The judge of the Higher Court in Podgorica, Miroslav Bašović, received 20.222 euros with interest because the state did not pay him a special allowance for a little over three years, but neither did he pay for the duty he performed for a period of half a year.
This is the first-instance verdict of Podgorica Basic Court judge Branka Zeković.
In the meantime, Bašović waived his request to be paid an undetermined amount of money for his past work over a period of eight years, so the judge rejected that part of the request as unfounded.
The Basic Court in Podgorica told "Vijesti" that the state appealed the verdict, so the High Court will decide on the merits of the appeal.
Bašović asked the state to pay him, on the basis of the less paid salary for the special allowance, for the period from September 1, 2010 to January 31, 2011 and from September 19, 2011 to November 30, 2014. the name of the principal debt of 13.150,93 euros with statutory default interest from December 28, 2018, when the expert made the report.
He also asked for statutory default interest of 5.696,33 euros, calculated from the due date of the individual claims until the expert's report. According to the Law on Courts, a judge who judges cases for criminal acts of organized crime, corruption, terrorism and war crimes is also entitled to a special allowance due to difficult working conditions and the specificity of the work he performs.
The special allowance is determined by the Judicial Council in the amount of up to one average salary in Montenegro.
Bašović also asked the state to pay him EUR 1 with statutory default interest from December 2016, 31, in the name of compensation for material damage based on the unpaid compensation for being on duty from October 2017, 1.213,05 to March 28.12.2018, 162,66. year until the final payment. He also asked for statutory default interest of XNUMX euros.
In his biography, it is written that he was elected a judge of the High Court in 2003, and previously he was a judge of the basic courts in Podgorica and Bar.
