The KOD organization and its members Budislav Miniić and Srđan Perić filed a lawsuit against the state of Montenegro and the municipal company Deponija due to the report from September 21 - that they illegally filmed the area near the Konik landfill with a drone, after which they were detained and detained in the Security Center.
They cite the minutes of the Civil Aviation Agency's inspection in which it was determined that drone filming near the landfill was not illegal, which is why they are filing lawsuits and seeking compensation of 5.000 euros that they would pay for the greening project of Podgorica - the 100.000 trees initiative.
While the KOD activists were taken into custody, the Police Administration informed the media that this was done due to illegal filming, which, as stated by Minic and Peric in the lawsuit, caused anxiety among family members, other relatives, friends and associates.
"At the same time, the PR service of the Police Administration untruthfully informed the media that they 'were filming without permission', which was clearly prejudicial to the findings of the competent state body, the Civil Aviation Agency," the lawsuit stated.
KOD members filmed the location of potential hazardous waste and sources of environmental pollution, which is outside the fence of the Livada city landfill, at around 12:XNUMX that day, with the aim of making a video about it that they would send to the competent inspection services and the media.
"On the devastated land, east of the 'Livade' landfill, the prosecutors (members of KOD) started recording with a drone a wild dump of car tires and the location of their burning. In a short period of time, a fire engine arrived from the area of the 'Livade' landfill with four members with the insignia on their clothing 'security' and with the so-called 'educational sticks'", the lawsuit stated.
Members of the "security" asked KOD members for permission to film the landfill and to hand over the drone to them, and after receiving an explanation from KOD representatives that they were working in accordance with the law, the Constitution and international conventions, and that such permission had no legal effect. validity, security called the police.
After discussing the legality of the recording and communication between the police officers and the authorities, the KOD activists were taken to the Security Center, where they were held until 16.45:XNUMX p.m., when the primary prosecutor, Romina Vlahović, announced that "in their actions, there are no signs of any crime for which they are being prosecuted ex officio ".
After that, the police released the KOD activists, with a report to the Civil Aviation Agency, which issued a report on October 2 that the filming was in accordance with the regulations.
KOD states that by filming a potential danger, they wanted to point out the threat to human health and the environment.
"In the manner described, by subjecting them to obviously unfounded procedures and conditions for several hours, the defendants (the state and the Landfill) prevented the plaintiffs (members of the Code) from collecting important information of public interest on the spot and from communicating it at the planned time and in the planned content and form to the competent inspection bodies and the public", stated this non-governmental organization.
