The Commission for the Control of the Public Procurement Procedure annulled, ex officio, lot I in the procurement of digital mammography systems for the Clinical Center (KCCG), general hospitals in Nikšić and Berane, as well as additional equipment for the KCCG.

Without going into the complaints of the Medica company, the State Commission established a significant violation of the Law on Public Procurement (PPL) and the non-compliance of the tender documentation of KCCG with the PPL, which could lead to discrimination of bidders and limitation of market competition.

The state commission found that "the determined parameters, for scoring sub-criteria of aesthetic and functional characteristics, were undeniably discriminatory."

The commission found that the identified inconsistencies in the tender documentation of the KCCG with the PPL could not be eliminated by any subsequent actions because all the deadlines for supplementing the documentation had previously expired.

The State Commission will return the money paid in the name of the fee for conducting the procedure in the amount of 12.000 euros to the company "Medica" within 15 days from the finality of the decision.
