Democratic Montenegro warns the Government of Montenegro that the deadline for it to act on the Decisions of the Constitutional Court of Montenegro in relation to former employees of Radoj Dakić is January 26 this year, the party announced.
"We remind you that by the aforementioned Decisions the Constitutional Court ordered the Government of Montenegro - the Ministry of Finance to pay compensation in the tax-free amount of 2000 euros to the applicants of the constitutional appeal - the bankruptcy creditors of AD Radoje Dakić in bankruptcy in the name of just satisfaction due to the violation of the rights from Article 32 of the Constitution of Montenegro and Article 6 paragraph 1 of the Convention for the Protection of Human Rights and Fundamental Freedoms (right to a trial within a reasonable time), within 6 months from the date of publication of each decision in the Official Gazette of Montenegro", stated in the press release of Vladimir Martinović, Vice President of the Democrats.
As he explains in the announcement, "the six-month period in which the Government is obliged to pay the former Dakić residents - the applicants of the constitutional appeal the amount of EUR 2000 each, we repeat, expires on January 26 of this year".
"We find the need to issue such a warning to the Government of Montenegro in the fact that the deadline for the execution of the decisions of the Constitutional Court expires in a few days, and until this moment, the public has not had the opportunity to receive any information about whether the Government and "The Ministry of Finance has undertaken the necessary activities for the timely execution of the relevant decisions of the Constitutional Court," the announcement states.
Martinović reminds that "Article 151 paragraph 3 of the Constitution of Montenegro prescribes that the decision of the Constitutional Court is mandatory and enforceable. Also, in the fourth paragraph of the same article, it is prescribed that the execution of the Order of the Constitutional Court, when necessary, is ensured by the Government. In this particular case The government is directly obliged to execute the Decisions of the Constitutional Court, so it would be more than scandalous if it happened to ignore this obligation," the Deamokrat press release states.
As he adds in the announcement, "the doubt that, unfortunately, a possible scenario of ignoring the Decisions of the Constitutional Court by the Government is encouraged by the fact that this very Government, for almost 15 years, has ignored the fact that around 1800 former employees of Radoj Dakić cannot collect their claims that were awarded to them legally binding and enforceable judgments of competent courts in Montenegro".
"If it happens that the Government of Montenegro does not act on the Decisions of the Constitutional Court of Montenegro within the deadline that expires on January 26 of this year, it will represent a kind of collapse of the legal order of Montenegro, and all responsibility for this will lie with the Government of Montenegro," it concludes. in the statement of Martinović.
