Lawyer Nikola Martinović requested that the director general of Radio-television of Montenegro (RTCG) Božidar Šundić be excluded from the disciplinary proceedings against the editor of the morning program of the Television of Montenegro (TVCG), Milica Babić.
Martinović, "Vijesti" learns, explained this by the fact that Šundić, before starting the disciplinary proceedings, announced to the media that he had sanctioned Babićeva and two of her associates with 20 percent of their salary for broadcasting Marko Perković Thompson's track in the TVCG morning program.
"In this way, he (Šundić) discredits himself and excludes himself from any decision-making, because without legally establishing the facts, he makes a statement about the guilt of my client on May 11, without previously carrying out any action provided for by law to establish the facts," he states. Martinović in the submission obtained by "Vijesti".
The public expressed concern over the fact that on May 9, a track by this Croatian musician was broadcast in the Morning Program, given that he is known for using a fascist salute at the beginning of his concerts.
Although the team of the Morning Program apologized to the viewers, two days later, before starting disciplinary proceedings, Šundić announced to the media that the three-member team (the editor of the Morning Program, the editor of the show and the music editor) would be sanctioned with 20 percent of salary.
He explained that "punishments are an act of responsibility towards entrusted duties and an integral part of functioning in RTCG".
Attorney Martinović, on the other hand, says that the editor of the Morning Program, Milica Babić, never received any act of disciplinary punishment: "Nor was she handed any act of such kind of punishment." Martinović also states that Babić only received a warning on May 14 about the violation of her work obligations, which she should declare within 15 days, which she will do.
"Given the well-known, publicly available and, finally, indisputable facts and actions taken by Šundić before May 14, it is obvious that he cannot act impartially and lawfully in the eventual disciplinary proceedings against Babić, so all the legal requirements for his exemption from such decision-making", states Martinović in the request for exemption.

Lawyers Vladan Bojić and Velibor Marković, attorneys for TVCG journalist Nevenka Ćirović, against whom disciplinary proceedings are being conducted because she announced on her Facebook profile that the film "Witness of God's Love" violates all journalistic standards, also requested the exemption of Šundić.
Due to the attitude on Facebook about the broadcast film, disciplinary proceedings were initiated against the journalist Zoran Leković.
