The dismissal of Samardžić is not according to the regulations: suspension, disciplinary, then dismissal

The dismissal of the chief city architect Ana Samardžić was not carried out according to the regulations.

The Administrative Inspection found this and ordered the office of the mayor of Budva, Marko Bata Carević, to make a statement about the case, that is, to eliminate the identified deficiencies.

At the end of April, Tsarević dismissed the chief city architect from her duties due to, as he stated in the decision, negligent performance of work and abuse.

Immediately after the dismissal of the official whose signature the construction in the metropolis of tourism depended on, the administrative inspection requested complete documentation for inspection.

They established, as "Vijesti" was told, that Tsarević first had to suspend Samardžićka, and then carry out disciplinary proceedings.

After the disciplinary procedure and the determination that it was a gross breach of duty, for which the first man of Budva accused Samardžićka, a decision on dismissal should have been made.

The Tsarević administration maintained that the decision was made according to the regulations, which it will explain in its statement to the Administrative Inspection. Samardžićka said earlier that she would seek her rights before the competent institutions.

In November last year, representatives of the Budva Civil Movement URA insisted that the work of the office of the chief city architect be controlled - because, as they said, of non-objective and biased decision-making.

The final straw for Tsarević to make this decision was the case of building a hotel on the land of Budva residents in the center of the city.

In the decision on the dismissal, Carević claims that the chief city architect did not respond within the legal deadline to the request for approval of the preliminary decision, and then "forced him to sign an illegal decision".

"By submitting an illegal decision to the president for his signature, which is contrary to positive legal regulations, she abused her official duty - because as an expert, she submitted an act from the domain of her competence to the president for his signature in order to give his consent to the proposed conceptual solution, even though she knew and had to to know according to the rules of the profession that the president does not have the authority to enact the same", it is stated in the decision on the dismissal of Samardžićka, which "Vijesti" had access to.

Locals twice complained about the decision of the city's chief architect to the Ministry of Sustainable Development and Tourism, which overturned Samardžićka's decision on two occasions.

She refused to give consent to the conceptual solution of the hotel, so that the Ministry of Sustainable Development and Tourism (MORT) recently, after she was dismissed, gave the green light to the conceptual solution.

After dismissing Samardžićka, Tsarević appointed Vladan Stevović as acting chief city architect.

With the entry into force of the Law on Spatial Planning and Building Construction, the Municipality of Budva established the Office of the City Architect two years ago.
