The company "Parking Servis" in Podgorica no longer issues a misdemeanor order for non-payment of the service, but a parking ticket, and a fine for the case that the vehicle is parked longer than it was paid by SMS, the fine is 2,40 euros.
As stated in the notification for the user, the parking ticket, i.e. the fine, should be paid eight days after it is issued, in order not to start the procedure for the enforcement of claims in accordance with the Law on Enforcement and Security.
The "Parking service" refers to the Decision on public parking lots in the amount determined by the price list. The price of an SMS message, if drivers use this type of parking, is from 0,40 to 0,70 euros.
As stated in the Decision on public parking lots on the territory of the Capital City, which was adopted on December 30 last year, the user of the public parking lot for whom the controller determines that he has not paid the fee in the manner prescribed by that document, the amount for payment of the fee is determined on the form issued by the Administrative Parking service board - parking ticket, which contains instructions for payment and the price of the parking ticket at a special rate determined by the price list. "The controller hands the parking ticket to the user of the public parking lot. If the controller is unable to hand over the parking ticket to the user of the public parking lot, he attaches the parking ticket to the front windshield of the vehicle. Delivery of the parking ticket in the manner referred to in paragraph 3 of this article is considered proper and subsequent damage or destruction of the parking ticket does not affect the validity of delivery and does not delay the payment of the parking ticket.
It is considered that the user of the public parking lot has acted according to the parking ticket if he has paid the ticket within eight days from the date of issue in the manner indicated in the parking ticket.
"If the user of the public parking lot does not pay the parking ticket within the period referred to in paragraph 5 of this article, the Parking Service will initiate the procedure for the enforcement of claims in accordance with the law regulating the procedure for enforcement of claims and the securing of claims," the Decision reads. In December, the Constitutional Court declared unconstitutional the Decision on public parking lots on the territory of the Capital City, and the local self-government made the same decision with a different name, according to which, as previously announced by the office of Mayor Ivan Vuković, they can now continue to charge for parking. Violation orders, which controllers previously left for drivers, were for the amount of 20 euros.
The Constitutional Court annulled the previous decision on December 26 last year at the initiative of lawyer Veselin Radulović, who in April 2015 submitted an initiative to MANS for the evaluation of several parts of the contested decision.
