The company "Explorer" will not be able to expand the restaurant on Black Lake, because that facility is located in the area of the "Durmitor" National Park.
This is written in the Draft Amendments to the Special Purpose Spatial Plan (PPPN) for the Durmitor area and the Draft Report on Strategic Environmental Impact Assessment.
In the part in which the requests received before the start of amendments to the PPPN were processed, it is written that the "Explorer's" plan for the extension of the restaurant on the Black Lake is not accepted
"The location is located within the NP "Durmitor", in which, in accordance with the provisions and recommendations from the report of the UNESCO Advisory Mission, the planned capacities cannot be increased," it was explained.
The company "Explorer", from Kolašinc Luka Bulatović, came into the public spotlight at the beginning of last year, when residents of the Durmitor region and nature lovers from all over Montenegro defended the Black Lake from the planned works.
The protests, which resulted in the victory of the citizens and the preservation of this jewel of nature, began after 42 trees were cut down in the Durmitor NP area, close to Black Lake, and the construction of bungalows was announced.
The citizens' initiative "You won't be able to do it anymore" won the termination of the contract with Bulatović's company.
However, at the end of last year, the Secretariat for Finance and Economic Development of the Municipality of Žabljak issued a temporary authorization to work for the second locale "Ice Cave" to Kolasinac at the end of last year.
In that decision, filed on December 30, 2019 under number 336/19-03-UPI-253, it was explained that based on the urban planning and technical conditions "it can be expected that the procedure for obtaining approval for the installation of the facility will be completed positively."
The President of the Municipality of Žabljak, Veselin Vukićević, confirmed to "Vijesta" at the time that the operation of the cafe "Ledena pećina" located on the shore of the Black Lake in Žabljak was approved by a temporary decision. "Along with the request for approval, the documentation prescribed by the Tourism and Hospitality Act was submitted, with the exception of the approval for setting up a temporary facility. Instead, the applicant submitted the urban planning and technical conditions for the preparation of technical documentation, which makes it clear that the procedure for obtaining approval for the installation of the facility has begun. In this situation, the decision-maker applied the institution of a temporary solution, prescribed by Article 19 paragraph 4 of the Law on Administrative Procedure. This is for the reason that he found it appropriate to, in the legal procedure, comply with the justified request of the party to legally carry out catering activities for the upcoming holidays", said Vukićević at the time. He explained that the adoption of that decision was the result of a joint consideration of the problem by the legal team of the Municipality of Žabljak, made up of several local government bodies.
"Within the bodies and services of local self-government and local administration of the Municipality of Žabljak, each body independently makes decisions within its jurisdiction. In certain procedures, it is necessary to involve more officials in order to make a correct and legal decision, but relations between authorities are not based on the principles of orders and pressures from the level of the president and vice president of the Municipality. I was aware of this problem before the solution. I believe that the adopted decision is legal, so I absolutely do not see the entire situation in connection with this as a reason for submitting my resignation. I believe that the issuance of such a decision does not represent pressure on the decision-maker on the installation of temporary facilities. In this particular case, the procedure related to the installation of a temporary facility is led by the Public Enterprise National Parks of Montenegro, whose decision the decision in question has no legal or factual influence," said Vukićević in March.
At the time, he also claimed that the decision, "based on the law", did not threaten the public interest, nor did it cause damage to third parties. "The decision is based on the realistic expectation that the process of obtaining approval for the construction of the facility will be completed positively, especially since the facility is included in the program of temporary facilities for the Durmitor National Park." Considering the above, it is clear that there is no room for a story about the responsibility of any person who participated in this procedure", said the first man of the Municipality of Žabljak at the time.
