The city enterprise Vodovod i kanalizacija doo Podgorica, in cooperation and communication with the German Development Bank "KfW", is carrying out the process of terminating the contract with the "Tošković"/"Tehnoput - MNE" consortium, which is carrying out part of the works on the secondary network as part of the construction project of the Purification Plant of waste water with the associated collector network, it was announced from the Capital City.
As they claim, the request for termination of the contract was submitted after it was established that the owner of one of the two construction companies that make up the consortium, Ivica Tošković, was legally convicted, after which the Podgorica Waterworks immediately reacted in the direction of eliminating all formal and legal irregularities and finding a solution for smooth continuation of project implementation.
"As it is a primary project from the perspective of the sustainable development of the Capital City, which provides the preconditions for its accelerated development in the next 50 years, and considering the fact that it is one of the largest infrastructure projects in the country that affects the improvement of the living conditions of our citizens, we are obliged to we highlight the following:
The contract with the consortium of companies "Tošković" and "Tehnoput - MNE" was signed on March 24, 2020, after the end of the tender procedure in which 2 consortia and one independent bidder participated. The phase of construction and expansion of the secondary sewage network, due to the large volume of work, is divided into two parts. The first phase (LOT 1, southern part) with a value of 1,83 million and a length of 9 kilometers was won by the "Tošković - Tehnoput" consortium. The second phase (LOT 2, northern part), with a length of almost 9 kilometers and a value of 1,5 million, is realized by the consortium "AG Infoplan/Eurozox". "Both consortia submitted orderly and correct tender documentation," the statement said.
They claim that during the public procedure they received certified statements from the applicants guaranteeing that they have not been legally convicted, therefore all responsibility in the application process and further implementation of the Agreement for such a statement rests with the applicant".
"The document in question was sent to the NGO MANS in a timely manner along with the entire tender offers of the bidders, after they sent an official request to "Vodovod" requesting the same. The tender procedure for awarding the Contract for the construction of the secondary sewage network in Podgorica - Lot 1 was carried out in accordance with the Procurement Guidelines of KfW Bank and in accordance with their standard tender documents. The bidder met all the qualification requirements and was awarded the Contract according to the bank's guidelines and rules," the Capital City press release states.
They also claim that the German Development Bank "KfW" is cooperating with the Podgorica Waterworks to solve this problem so that the newly created situation has minimal consequences on the development of the project, and therefore on the citizens for whom it is intended.
"The termination of the contract, therefore, is carried out in accordance with the FIDIC procedure and domestic legal norms, with the aim of minimizing the consequences on the further development of the contractual activities", it was announced from the Capital City.
