The order of public executor Jasmina Bojović to "remove" half a million euros from the account of the Municipality of Herceg Novi for the LED lighting project was the reason for the urgent press of the head of the Herceg Novi local administration. The contract for the installation of LED lighting was assessed as corrupt, and the case is with the Special State Prosecutor.
The municipality of Herceg Novi, when the coalition DPS - Izbor was in power, based on the tender procedure, in 2015 signed a contract with the Danish company HeSa Light on the installation of LED lighting in the municipality of Herceg Novi, worth 2,69 million euros, but the technical acceptance was never was not executed. HeSA light went bankrupt last year, and two companies - Novalume from Denmark and HeSa Light MNE - applied to the Municipality of Herceg Novi as legal heirs.
"We still don't know for sure who the legal heir is, that's why we immediately forwarded an objection to the execution of the public bailiff's order, and next week we will prosecute all the actors who were connected to the LED lighting contract," said Katic and stated that the Special State the prosecutor's office has been investigating the rumor about the installation of LED lighting for two years.
"The contract that was signed with Hesalight is an example of a classic corruption contract," asserted the President of the Municipal Assembly, Miloš Bigović.
He stated that "the contract itself contains provisions that are mutually contradictory, which leaves room for an elaborate scheme in the relationship between lawyers-public executors-new companies that appear as alleged legal heirs, to create a basis for extracting enormous funds from the Municipality of Herceg Novi baseless," said Bigović.
He clarified that according to the contract, the obligation of the Hesa light company was to submit the first invoice for the work performed to the Municipality of Herceg Novi six months after the installation of all lamps.
"That was not done because if the company submitted an invoice, to which the Municipality has the right to file an objection, the entire process would be moved to a civil proceeding," said Bigović.
"They avoided this by presenting us with a promissory note, which, if our objection is not accepted, we have to pay, for the simple reason that when it comes to a promissory note, the objection does not delay execution. It is a deliberate concept to directly damage budget of the Municipality of Herceg Novi, although the work they were supposed to do has not been completed. We are sure that the public executor, not knowing the factual situation, is either misled or has some interest, which I am sure will be determined in the future," he emphasized. Bigovic.
He said that the Municipality of Herceg Novi "does not run away from payment", but that due to their responsibility towards the citizens, they cannot pay for unfinished work.
Chief administrator Nenad Đorđević said that "the essence of the objection of the Municipality is that it challenges the legitimacy, that is, the right of the new company Novaluma, to the legal succession of the previous company, which is a contracting party".
"The other company that comes forward, Hese light MNE Podgorica, also aspires to the position of a contracting party, but that company did not initiate any procedures regarding this problem that we have today. There is an obvious conflict between two legal entities, one based in Denmark and one in Montenegro , about who is the legal successor and who wants to come to the position of contracting party", Đorđević is convinced.
"The municipality will undertake all legally permitted actions in order to protect the citizens of Herceg Novi. If the competent authorities do not accept our arguments, which we are one hundred percent convinced are accurate and correct, we will not shy away from any activities in order to protect the citizens and the budget of the Municipality of Herceg Novi New", said Bigović, fearing that by activating the remaining promissory notes, the Municipality would have to pay another 2,2 million euros.
1.000 lamps are not working
In the public tender for the installation of LED lighting, the best bidder in 2015 was the Danish company "Hesse light", which was supposed to replace 6.000 light bulbs. deadline, maintain lighting.
According to estimates at the time, the financial savings should have been 70 percent, which should have meant that the lighting could pay for itself in a few years. At that time, the municipality of Herceg Novi allocated 40.000 euros per month for public lighting, and with the introduction of LED lighting, the monthly bill should have been 15.000 euros.
The Belgrade firm Eco power energy efficiency filed a criminal complaint with the Special State Prosecutor against an unknown person in the Municipality of Herceg Novi, regarding the work on the installation of LED lighting. At the time, the local administration assessed the criminal complaint, as well as other criticisms of the installation of LED lighting, as "malicious claims, which have a purely political background".
