Pržno: The building threatens the entire settlement

The residents of Pržna, 33 of them signatories of the petition, urgently asked the Secretariat for Urban Planning of the Municipality of Budva to cancel or revise the building permit it issued two and a half years ago, which, they claim, allowed the construction of a six-story building on the very road, which endangers the safety of the surrounding houses and buildings.

It is an attractive location, next to the Jadranska magistrala at the very intersection towards Pržno.

The petition was submitted to the departmental secretariat, which is requested to react urgently because earthworks have begun, which basically exceeded the square footage provided for in the current detailed urban plan.

The Secretariat for Urban Planning, as written on the municipal website, issued a building permit to Dejan Marinović and Aleksandar Vujović from Podgorica on November 1, 2018, for the construction of a tourist apartment facility with a total gross construction area of ​​1.495 square meters, of which 960 are residential. The number of floors in the building is PO+SU+P+2+Pk (basement, basement, ground floor, two floors and attic).

"We oppose the performance of works on urban plot number 19, within block 19, which consists of cadastral plots 547/1, 546/2, 1920 /16 KO Sveti Stefan, because the building permit was issued in violation of the Detailed Urban Plan "Kamenovo - Vrijesno" and valid legal regulations. Namely, according to our knowledge, the DUP allowed the construction of a building with a base of 190 square meters on the urban plot in question, while the disputed building permit allows Marinović and Vujović to build a building with a base of 250 square meters. We would like to point out that on the urban plot in question, even the DUP, in terms of surface area, was not done in accordance with the applicable law," the petition states.

Locals warn that the investor is not in compliance with the current legal regulations, within seven days from the date of issuance of the building permit, he pointed out, at the place of construction of the building, a board with information about the issued building permit.

"This made it impossible for us to get acquainted with the fact that the building permit was issued in the prescribed manner, so that we could react in a timely manner and cancel it. We are asking for the annulment, or ultimately revision of the building permit, because by building the building in the way that the investor is currently doing, all of us who own buildings in the surrounding area will have a blocked view of the sea. And not only would our view be obscured, which would reduce the value of our residential buildings, but the quality of our life would also be reduced," the residents state in the petition.

They specifically pointed out that due to the configuration of the terrain and the way it was undermined, "the stability and safety of buildings in the immediate vicinity of the disputed construction site is at risk."

"The safety of passengers passing through the main road is also at risk, which we informed the competent inspection in a timely manner. That's why we submit a petition and ask you to take all the necessary legal actions as soon as possible to protect our basic rights, which are guaranteed to us by the Constitution and the law of Montenegro," the petition concludes.

The construction permit, as stated in the decision of the Secretariat for Urban Planning, published on the municipal website, was issued in accordance with the Law on Spatial Planning and Building Construction.

"The construction of a tourist facility is approved according to the conceptual design and the report on the revision of the conceptual design, which was done in accordance with the urban planning and technical conditions issued on the basis of the Detailed Urban Plan "Kamenovo - Vrijesno", it was stated in the decision.

Investors previously received a traffic permit from the Secretariat for Communal and Housing Affairs, and settled utilities with the Municipality of Budva, as well as paid compensation to JP "Regionalni Vodvodek".
