The public company Regional Water Supply of the Montenegrin Coast from Budva, as an investor, and the contractor - the consortium Indel Inženjering-Ramel-Civil Engineer, not even twenty days after they officially completed the eight-month work on digging the Adriatic highway in Tivat for the construction of the missing branch of the Regional Water Supply towards the municipality of Herceg Novi, they did not remove even a kilogram of over 14.000 cubic meters of excavated soil and rubble from the construction site, which they illegally dumped on part of the former Montepranzo agricultural property in Tivat.
The "News" from the Municipality of Tivat were offended that the Regional Waterworks and the consortium that carried out works worth 1,8 million euros for that company, despite warnings that they must do so as soon as possible, have not yet started the removal of the illegal construction waste dump that they devastated in the previous months. part of the former orchards and vegetable gardens on the agricultural estate.
"This has exceeded all measures and the Municipality will now be more decisively and efficiently involved in solving this problem and prosecuting all those responsible for this vandalism and inappropriate attitude towards the environment, but also valuable agricultural land that is subject to restitution and which the Municipality, in cooperation with its owners, intends to return it to agricultural production in the coming period," Vice President of the Municipality Vladimir Arsić (NP) told "Vijesta" yesterday.
The construction of the missing 3,2 kilometer pipeline for the Regional Water Supply in Tivat, apart from harassing the citizens for months because of the dug-up of the main city road - Jadranska magistrala, also turned into a kind of ecological scandal.
Contractors from the Indel Inženjering-Ramel-Civil Engineer consortium literally buried part of the former vegetable gardens and vineyards on the area of the former Montepranzo-Bokaprodukt agricultural property, which is located opposite the Tivat airfield, with thousands of cubic meters of soil from the excavations for the trenches in which they laid the water pipes. , scraped asphalt and other construction waste. All of this was done in violation of the current regulations, which stipulate that for the disposal of smaller, not so large, amounts of material that is considered non-hazardous construction waste, there must be a disposal plan as well as a permit and approval from the competent local self-government body.
Such material can only be disposed of at a location that is officially designated, equipped and arranged for a construction waste dump, and which must also have its own official manager.
The new city administration of Tivat, as previously confirmed by the "News" from the administration of the mayor Željko Komnenović (NP), has launched an internal investigation into who is responsible for the devastation of the area of the former agricultural property in the relationship between the Municipality - Municipal Enterprise Tivat - Regional Waterworks. They announced that they will insist on establishing responsibility, but also on rehabilitating the devastated area, at the expense of the person who illegally brought and discarded a little over 14.000 cubic meters of excavation and rubble.
According to the documentation found so far, the former Municipal Acting Secretary for Investments, Spatial Planning and Sustainable Development Marko Petričević (DPS) on two occasions ordered the Tivat Municipal Company to enable the "temporary deposit" of excavations on the area that that company uses in the acquisition of the former agricultural property. and construction rubble from works on the regional water supply.
At the end of May last year, the administration of the former DPS mayor of Tivat, Siniša Kusovac, enabled the Regional Waterworks, headed by a high-ranking DPS official and coordinator of the party's head office for Tivat, Goran Jevrić, to carry out work on the construction of the missing part of the pipeline for Herceg Novi, on the stretch from Opatovo to Under Kuka, the works were drastically delayed and caused huge problems for the people of Tiv, but all this was tolerated by the former DPS administration of the city.
The utility company Tivat has been renting and using thousands of square meters of former vegetable gardens and orchards that were formally owned by the failed state agricultural company Montepranzo Bokaprodukt for several years under the contract concluded by former director Tonko Lukšić (DPS).
For these purposes, Komunalno paid Montepranzo, whose management board was then headed by high-ranking DPS official Andrija Radman from Herceg Novi, a little over 4.000 euros in rent per month, although at the same time the company owes tens of thousands to the Municipality, which is the owner and founder of the Communal Enterprise. euros for unpaid real estate tax.
The Regional Water Supply never answered the questions based on whose permission the former agricultural property owned by the failed state company Montepranzo-Bokaprodukt is being destroyed by dumping construction waste. This land now has the status of a construction site, because it is planned to build a golf course on it, according to changes in the planning documentation from fifteen years ago.
In Tivat, there has been a campaign for the restitution of this once almost completely private land to its original owners, because its purpose has been changed compared to the one for which these properties were taken from the local population at symbolic prices in the XNUMXs. The new Tivat local government of the NP-BF-GB civil list coalition has announced that it supports the demands for the restitution of that land to the locals and will request that the golf courses be deleted from the plans and that this complex be returned to agricultural production.
The prosecution is not interested in investigating whether the money ended up in someone's pocket
The Regional Waterworks, i.e. the company that performs the works for that company in Tivat and the company that supervises these works, never answered why they deposited all the rubble and waste from digging over three kilometers of canals in the body of the Jadranska magistrala on the former agricultural property, and who and when from the Municipality allowed them to do such a thing.
It was not answered whether the tender stipulated the obligation of the contractor to take that material to a proper landfill and which landfill was contracted. In the area of the Municipality of Tivat and Kotor, there are currently no legal landfills for inert construction waste, which includes excavated soil and scraped asphalt from the highway, so the contractors who worked for the Regional Waterworks had to take it, at the very least, to Budva or Cetinje.
In the tender documentation published by the Regional Waterworks on the website of the Public Procurement Administration, it is stated that this job in Tivat includes "loading, transport, unloading and rough spreading of excavated materials at a landfill up to 20 km from the construction site", and that the total excavations amount to 14,683 cubic meters.
However, under extremely suspicious circumstances, all that material ended up just 3-4 kilometers from the construction site - in the former vegetable gardens and vineyards near the airport. Therefore, the question arises as to whether any of the contractors, in agreement with the investor, in this way achieved illegal savings in the obligations they undertook and which were paid to them from state funds, and perhaps shared the difference with the managers of the Regional Water Supply and put it in their own pockets. .
Although everything that happened on the former agricultural estate in Tivat is a criminal offense under the Law on Waste Management and other laws on environmental protection, the Basic State Prosecutor's Office in Kotor has so far found no motive to get involved in the investigation of that scandal.
"Regarding your questions, we inform you that no cases have been opened in the Basic State Prosecutor's Office in Kotor regarding the mentioned media inscriptions, and we point out that in this particular case it could possibly be about illegal actions of public officials, for which the Special State Prosecutor's Office is actually competent," she said. to "Vijesta", spokeswoman for ODT Kotor, state prosecutor Ana Marinović.
We were told by the SDT that the prosecutor's office has not created case files in the "Montepranzo-Regional water supply" case so far.
